First time member here and I already learned a lot from this site. However, Im still a little confused and lost. Im a US permanent resident eligble to apply for citizenship now(been here since december of 2004). I have my fiance in the Philippines and I would like to bring her here with me in the US. Im looking for the fastest and the most sure way to get her here. So, :

Do I apply for citizenship first then petition her as a fiance?(i just got back from the Philippines from a vacation and i heard you have to wait 3 months before you apply for citizenship since I was out of the country)

Do I apply for citizenship first, marry her in the Philippines then petition her as a spouse?

Or, Do I marry her in the Philippines and then apply to petition her as a spouse?

Thank you so much guys and more power!!

You must be a U.S. citizen first in order to be eligible to file a petition and bring "her" to the U.S.

It's really up to you to choose if you'd take the K1 or the CR-1 route. Maybe you and your fiancee can talk about the visa options and decide together.

Right now, you really should be focusing on becoming a U.S. citizen first. Broaden your research about that and start the process.

No wait for 3 mos for naturalization if you have been out 3 mos., if you had been out for 6 mos. then you might be waiting 5 more years

You must be a USC to bring your fiancee here or if you want her to arrive on a K-3 spousal visa

As an LPR you CAN petition for your spouse but it will take some time. As a USC petitioner it is much faster.

YMMV

Hi,

The best way in which to get your fiance into America is via the K1 - Fiance Visa. It takes about 7 months or so. I take it you intend to marry?

You will need to get your citizenship before you apply for the K1 visa.

Good luck

Just do waht they do here in San Diego.....smuggle her in from Tijuana mexico......I hear it's very easy.. :jest:

Seriously, the previous answers are your best bet... you need citizenship... and likely K1 Visa will be quickest in your case.

Here are the continuous residence and physical presence requirements for citizenship: Link

With regard to getting her here in a timely manner it is better to file as a citizen, as the others say. However, there are other considerations when making your decision. For example, will she want to begin work or travel out of the country right away? If yes, then the K-1 is not the right visa for her. The extra couple of months it takes to obtain a CR-1 visa is more than worth it. But that's just my opinion. There are many many circumstances and many many reasons why people choose the visas they do. your best bet is to be informed at the outset.

I am moving your thread from the K-1 Process forum to the General Immigration Discussion forum. Welcome to VJ. :)

Thanks for the helpful response guys I really appreciate it!!! So the fastest way to get her here is by petitioning her as a fiance rather than as a spouse?? We dont plan on her to be working here no be leaving the country immediately our main goal is just to be with each other the fastest way and less riskiest way.

Heres my plan guys:

-Ill process my citizenship and with Gods help , obtain one before this year ends

-Get married March or April 2011

- Petition her as a spouse ( As a fiance, i think it would be riskier since we still need to prove that we've been together long enough and all those )

what do you guys think??

Thanks VJ!!!

certainly your choice but I think you misunderstand the fiancee requirements for petitioning... validity of the relationship is needed for either visa

YMMV
