this is for my aunt: she has filled I-130 for his son around in August 1980 and got approved Sept. of 1990 USCIS however that time during the petition process my aunt was only a green card holder and around Sept 1990 my aunt became a US citizen ...and from there on the case didnt moved because of the situation. I wanted to know whats the best option whether if I should start on on a new case which is IR petition or continue with the same old petition and just do an upgrade. Any help is highly appreciated. Thank you

I think she has to call USCIS, and send in a cover letter with a copy of her naturalization certificate, to kick that I-130 back into play.

I found this.. If you filed a petition for your spouse when you were a lawful permanent resident (LPR), and now you are an U.S. citizen, you must upgrade the petition from family second preference (F2) to immediate relative (IR). You can do this by sending proof of your citizenship to the National Visa Center (NVC). To prove that you are a U.S. citizen, you can send:

* A copy of the biodata page of your U.S. passport; or

* A copy of your certificate of naturalization

HOWEVER WHEN I CALLED..nvc it says the case was forwarded back to USCIS.. so i dont know whats next to do

when she became a citizen, she should have notified the USCIS or immigration...whatever they were called then...then it would upgraded to an immediate relative. In this case I dont know what would be the best bet..it might be better to reapply...but there will be people with more knowledge on this to come along...

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

my aunt has a son: whom she petition august 1997. and then the son was issued an MNL case no in the same year after the it was forwarded to the NVC. however upon checking the status on the NVC ivr system it says the petition has been forwarded back to USCIS.

issue: during the petition aunt was only a green holder and during the immigrant process, my aunt got naturalized .

aunt- appx 55 years old

son- appx. 30 years old

** question whos department should they contact to upgrade the petition? USCIS or NVC. and what documents should be provided. thank you

He has a few years to wait for his number to become current.
