hi again, i just wanted to know that when filing or the k-1 visa, if i send a letter (eg. letter of intent to marry) or any letter that require both hers and my signature, is a copy acceptable.

basically if email/fax her the letter with my signature and she signs it, then emails/faxes it back to me , is that acceptable?

Unfortunately, no, Anywhere a signature is required from either of you, both of them are supposed to be orgiinals - not copied, not faxed, not scanned.

Letters of intent need to be signed (original signatures), preferably in blue ink so that you don't get an RFE for a mistaken photocopied signature.

Even the cover letter should be signed by both parties in original signatures.

We got an RFE for sending photocopies of the G-325A, instead of ones with original signatures.

Absolutely,

ALL signatures need to be original. Best bet is to use BLUE ink so that USCIS does not mistakenly think documents signed with black ink are photocopies.

Certain documents that are included in the I-129F petition package can be copies (passport pages, birth certificate, etc), but signatures can not be duplicated for the I-129F, 325A, letter of intent or cover letter.

Absolutely,

so could i have her sign a letter of intent (seperate from mine) and have her mail (usps) it to me, or would i have to mail her my orginal signed letter of intent, and have her sign it and send it back?

Email her a letter for her. There should be 2 letters. One from you, and another from her. Email it to her so she can print it, sign it, and mail it to you!

Email her the letter of intent for her to print out and sign, then have her mail it back to you USPS.

There is nothing in your initial I-129F packet that requires notarization.

Use a cover letter also (examples are posed here on VJ). Email her this also, have her sign it and send it back to you USPS with the letter of intent,

Also - another helpful hint - **Check expiration dates for the forms you are submitting. The G-325A recently changed from a 4 page form to a single page.

Don't forget proof of meeting and proof of ongoing relationship. The more information your provide the less likely you'll receive a RFE.

thank you all VJ members again for the helpfull advice

Because of the cost of both money and time, I decided to risk it and send scanned signatures from my fiancee Andrea. Considering all the warnings I told her to do a high quality print and scan. What she sent me was a small, faint signature, so I had her re-do it and sign bigger with a thick pen/thin marker. She sent me back a much better signature, we sent them in, and it was approved. It may not work everytime, but may be worth the risk if your fiance has access to a good printer and scanner. Remember to then do a high quality print yourself.

09/20/2009- Met for first time in Bogota

09/25/2009- Fell in love.

09/14/2009- USCIS received our packet

One more thing: An RFE is not the end of the world or anything and shouldn't delay things too much. Put it this way, if getting the original signature will delay sending your application for a week or more, you're not risking much by scanning it. If you do get an RFE just have your fiance send the document directly to the service center from abroad.

It never occurred to me to have my then-fiance sign the cover letter, esp since I was the petitioner & not him. Wasn't an issue.

One more thing: An RFE is not the end of the world or anything and shouldn't delay things too much. Put it this way, if getting the original signature will delay sending your application for a week or more, you're not risking much by scanning it. If you do get an RFE just have your fiance send the document directly to the service center from abroad.

I would add that an RFE would add more than a week. They issue the RFE, then mail it, then it gets to you, you do what it says, mail it back (with the RFE letter inside), it has to get to them, be received AND processed.

But if the mail from the OP's fiance to the OP would take a week or more to get to him, he may as well file it with a scanned/faxed signature. Meanwhile, have her mail him the original signature. So at least if he gets an RFE, he already has the signed paperwork and can return it the same day.
