Question:

Do I have to do a police background check if I am in the USA and doing AOS?

02/22/2010 - Got Married.

04/24/2010 - Sent I-130, I-485, I-765 and I-131 to Chicago Lockbox

04/26/2010 - Package received in Chicago @ 10.16 AM by K Walker (Day 01)

04/30/2010 - Both cheques cashed / Entered in USCIS system (Day 05)

05/04/2010 - Received all 4 NOA's dated April 30, 2010 (Day 09)

05/24/2010 - Biometric letter received (FINALLY!!!)(Day 29)

06/02/2010 - Biometrics walk in DONE!!! (Day 38)

06/17/2010 - "Original" Biometrics appointment (Day 53)

06/21/2010 - Interview letter (dated June 17, 2010) (Day 57)

07/07/2010 - Approval AP (I-131) (Day 73)

07/09/2010 - 1st EAD (I-765) Card Production Order (Day 75)

07/14/2010 - 2nd EAD (I-765) Card Production Order (Day 80)

Yes you do. My husband was here on a visit when we decided to get married (he had come on the VWP) and we had to obtain a police report from the Australian Federal Police to send in with our AOS packet.

Hmmm, I came here on a J-1 visa. I didn't have to submit a police report either with the application for the J-1 or the AOS process.

Shoot for the moon - even if you miss, you'll land among the stars...

AOS completed in 11/2009

ROC completed in 06/2012
Received BBG from Germany in 02/2013

Passed N-400 interview and civics test 06/07/2013

Oath ceremony some time in July

Really? Most people I know didn't have to do this (get police certs) when sending in the AOS (in the US).

Did they cite a rule or regulation for this?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

We didn't send in a police report either... I didn't see where I needed to send in a Police Report...

My husband came over on the VWP and hopefully we don't receive an RFE over this.. although he has no record.. i just don't want to slow things down. Hopefully someone will clarify this. If not, hopefully I can update how it went for someone going through AOS after coming here on the VWP.

We didn't and my lawyer didn't mention it. Although they did say that if I had something in my background I should tell them and let them know before they find out and throw it back at me during the interview. They are the all seeing all knowing! Hahaha!

Hey you guys, we didn't send one either. I think it's just for if you have a criminal history/something on your record more than small speeding fines etc... At least that was my understanding of the instructions...

Laura & Kyle don't worry, I got an interview letter without sending one and Betti's approved, so I think you're all set! :thumbs:

Nov 13, 2012 Got text/e-mail with case number & the check was cashed :)

Nov 14, 2012 Case updated online to say biometrics apt. notice is on its way!

Nov 16, 2012 Received NOA & biometrics apt. letter
