Timeline

Hello Folks,

When I get my fiancee here to America with her K-1, is there a time limit on getting a green card? Yes, I realize she probably cant drive or get a job without it but is it something that is required? Has to be done in a certain amount of time? Dont those things cost like $900? What or other consequences to not having one? Thanks and I will start working on my timeline soon.

No official time limit, but when her I-94 expires and the I-485 has not been submitted, you will not have anything to prove her "legal" presence. If her immigration status is checked for some reason then she could be placed in removal proceedings. AOS is $1,010.

So how long typically does an I-94 last?

No official time limit, but when her I-94 expires and the I-485 has not been submitted, you will not have anything to prove her "legal" presence. If her immigration status is checked for some reason then she could be placed in removal proceedings. AOS is $1,010.

Cost is $1010.00

No - there isn't a hard "time limit" - with that being said, once your I-94 expires, you are "out of status".

Which means you could have problems with ICE, it has happened to some people.

Also, you will be accruing "out of status" days, go over 180+, 3 year ban, go over 1 year, 10 year ban (if you leave the US and attempt to re-enter - say on the AP - once you get the Greencard, your ok).

Depending on the state your in, you may not be able to get a state ID or drivers license (they use your immigration status as the date it would expire, in this case, the I-94)

And finally, if you go past one year from the medical, you will have to complete another medical, which adds more cost.

So I always recommend to do it sooner than later, and to do it before the I-94 expires. Once you file for the AOS and get the NOA, your status is "applicant to adjust", and you are "safe" from ICE.

(again, if you have out of status days more than 180+, don't bother with the AP)

So how long typically does an I-94 last?

90 days from entry.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
