It is alright to visit with a tourist visa, but you will not be guaranteed to be allowed to enter if they don't feel you have enough strong ties to your home country. Do not lie to the Immigration Officer when asked the reason for your trip to the U.S. You can be banned from the U.S. if they determine you were untruthful when trying to enter the U.S. Just tell them you are visiting your husband and that you intend to return to your home country until after your Visa application has been approved.

You can take your most recent pay stub or mortgage/lease documents as proof that you intend to return to your home country after your visit with your husband.

My boyfriend and I are still wondering if we should apply for K-1 or K-3. We want to get married in my country (Guatemala) but at the same time, we do not want to be separated after getting married. At first we thought we could apply for K-1 and get married in the States and later ask for an advance parole so I could come back to Guatemala for the religious wedding, but the advance parole seems to be another long procedure.. so maybe K-3 and traveling with my tourist visa in the meantime, will work for us.

My husband and I got married in the UK because the fiance visa approval was faster there, and then we filed for K3. We have been living apart now for 4 months. So, while the wait for a K1 visa can take longer in the US vs. other countries, I almost think it's better to get married in the US. That way you don't have to be separated after the wedding, because your spouse can stay and adjust status.

Clearly you will have to do what's right for your situation, but overall, it seems to be best to get married in the country where you intend to live. The foreign spouse seems to have more rights to adjust status in that country. It would have been far easier for me to adjust status in the UK since we married there. Just my 2 cents.

I absolutely 500% recommend getting married in the US, especially since you have your tourist visa. I got married to my husband in Venezuela in February. We didn't want to be apart after the wedding either so I decided to stay here with him until he got his K-3 and we would travel to the US together. Well we are still in Venezuela and still waiting for the K-3!! Regardless of the IMBRA complications, which now shouldn't really affect you, applying for a K-1 takes approximately a month and a half and applying for the K-3 would normally take 60-90 days so the K-1 is much faster.
