I-864 Problem Please help!

My Fault here, my husband told me to start doing the paper works (AOS) last december

but i just ignored it, thinking i still have more than a month to prepare before my K-1 Due.

not knowing that i will need the tax transcripts again from K-1 to AOS.

When it comes to paper works i cannot depend on him

he don't have more patient when it comes to it...

our problem here is not having the federal tax return copy for 2008

and for the question on I-864 #25 asking about the total income for

the past 3 years gosh! he don't know..he dont have a tax return copy..

those 3 years different total income?

i am worried now on my K-1 due by the end of this month

if we order the tax transcripts for 2006,2007.2008 it will take us 2weeks before we get the copy..

by that time my K-1 expires..

i know this is very important.. but i have some supporting copies of W-2's

2006,2007 and 2008 here..

My husband wants to send this AOS soon but i know

if we don't have the federal tax copy included we will get RFE.

some friends told me to calm down and just order tax transcripts and wait

so i will have a complete needed documents to avoid RFE.

right now, my headaches!! (my husband wants to send our AOS this week)

i dunno what to do...

March 29/2010 EAD received!
April 29/2010 USCIS updated change of address from TX TO MS
July 7,2010 MY FIRST ULTRASOUND -->> WE ARE HAVING A BABY GIRL!!!!

The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made.
JULY 27,2010 AOS APPROVED
AUG.12/2010 CHANGE ADDRESS THRU FON AND FILED AR-11
AUG.16/2010 RECEIVED LETTER FROM USCIS THEY ACKNOWLEDGE THE CHANGE OF ADDRESS.
AUG.17/2010 - GREENCARD AT LAST!
Nov.18,2010 - Bouncing baby girl named ARIELLE FINES CAMPBELL!
April 2012 - Lifting of condition (1-751)
May 2012 - Due- welcoming our 2ND Baby and it's a Boy!

August -->>> N-400!!!! can't wait!

I think I've read somewhere that you may still file for AOS within 180 days from your arrival. It's only the marriage that has to take place within the 90-day period.

I also spotted a post just this week that if your husband has filed his taxes in the past, he could try calling the IRS and request them to fax him the transcripts. They might do that within a day.

Your friends are right. Calming down will help you think better.

Your K1 was CANCELLED the monet you entered the USA, it does not expire. The xpiration date is the date by which you must enter the USA. The K1 is replaced with the I-94 when you enter and you must be married before the expiration date on the I-94, I presume you have been, so stop worrying

There is no particular deadline for filing AOS. Calm down, order the tax transcripts and file when you have all the papers. DO NOT send it before you have everything you need. Better to wait two weeks than have a 4-5 week delay

Also IMHO

1. Tell your husband to stand up from his @ss and get this done for you

2. NEVER send off your last copy of ANYthing to ANYone, always retain at least on copy for yourself, you will need copies of tax returns over and over again for various reasons in life and adults ought to have that sort of information in the top drawer of their desk.

Also..not your fault. I had ALL AOS papers done and ready BEFORE my wife arrived in the USA. We added the marriage certificate and copies of her I-94 and sent them off. Our son came on a K2 to follow and we filed his AOS within 2 hours of his arrival, all papers being ready before and only a copy of his I-94 needed. Your husband dropped the ball and neglected to do this very important aspect. The only thing you needed to do was sign the papers.

Don't despair! Just ask for the tax transcripts from the IRS :) There should be a form for it at the IRS website. Or you can request copies by calling them too.

My husband and I went through the same thing with his 2006 tax return but thankfully, he was able to find a copy - he went through ALL of the documents he kept here at home. He has no patience with paperwork either - I handled all the AOS docs and he just printed them out and looked them over after I was done - but he does keep all important documents in folders so all we needed to do was go through all of them (it took us about 2 days, LOL).
