Hi everyone,

Well so me and my fiance John did not have a good day, yest was a bad day.I have been sick and also eagerly waiting to hear about the NOA2s and all.And he just called me yest saying that he got fired from his job yest.:(

That was such a shock to take in,I had not seen that coming.

We are of course going to figure a way out,but what is the best way out.

We are in the NOA2 waiting stage,so when he sent out our petition,he had included his employment letter.

What do you think happens?

He will try to look for a job and all,but assuming VSC suddenly wakes up and sends us all approvals, should we decide on a co-sponsor for the I-134 or wait?

Also,if we did,it will be his father,but will there be a discrepancy since we had included his employment letter in the original petition?

I will really appreciate any advice .And everyone's hope and optimism is commendable !

yes we are exploring that now.

so now instead of him having to fill out the I-134 ,the co-sponsor would right?

Or am I missing something here?

The employment letter was not needed for the petition. Irrelevent documents included in the petition make no difference.

It is co-sponsor or you will have to forfeit the visa petition unless he gets a job that pays above the required level.

I would get over to a temporary service and sign up right away and get them to sign a letter, and if absolutely necessary, maybe his mom or dad will sign a form to help him out, but it could be hard to get someone else to want to agree to 10 years of support.

I am sorry but I could not understand what you meant by 'get over to a temporary service and sign up'.Did you mean him looking for any temporary job for now?

I mean get over to a temporary agency and sign up, now he works for them and they should provide a letter, and he might even have a job for a few days. He might not get good pay, but it should be enough to keep immigration happy. It doesn't say you have to have a permanent job, it just says you have to make a certain amount of money. That is what I would do if in that situation.

10 years? It's actually could be indefinite, unless one of the four conditions occur;

1. The LPR is credited with 40 quarters of work. (which takes 10 years of work usually) - if the LPR never works, they will not meet this one (however, in certain cases the work of a spouse adds qualifying qtrs)

2. The LPR becomes a USC.

3. The LPR dies

4. The LPR ceases to be a LPR and departs the USC.

Divorce doesn't end this obligation.

So it is a serious obligation.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

He might not get good pay, but it should be enough to keep immigration happy. It doesn't say you have to have a permanent job, it just says you have to make a certain amount of money. That is what I would do if in that situation.

Actually - they look at the ability of your maintaining income - not that you just have a job. (The I-864 (which they use to judge the I-134 most times) even gives them the leeway to project out 5 years in considering the case/income)

Read the instructions for the I-134

B: Statement from the Employer

1. Date and nature of employment

2. Salary paid;

3. Whether the position is temporary or permanent.

If I was you - I would get a co-sponsor lined up.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Who in this case is the LPR?He is the US citizen by birth,or were you referring to me becoming the LPR in the future?

I am damn sure he will not remain jobless,everyone finds a job,time is what we need and unfortunately in our case we are hard pressed on it now.

But I am sure ,he will find something,we do not have to be depending on his father forever.Just this excruciating process.

The LPR would be the benificiary on the I-134 (and eventually the I-864).

I was adding information to Filipina Lovers statement about the support only being 10 years. Not in all cases is that true.

Don't worry about a discrepancy. The employer letter was not needed with the petition, so would have been ignored anyway. When it comes time to provide the I-134, if you need a cosponsor, use one.

Be aware that most Temp Agencies will NOT do a letter of Employment for a person. I know this because I was in the same situation, so what I did is copied my check stubs from that Temp Agency and typed my own letter stating the reasons and had it notarized and included it with my I-134, and it was never even questioned during my Wife's interview. I am now employed full-time, thank God.

01/05/12 - Mailed I-751, Petition to Remove Conditions.

01/09/12 - Petiton arrived us VSC.

11/15/12 - Wife Received ten year PR Card.
