Hi. THis is me Laurie here. I am from Illinois. I wasn't too sure how to proceed my divorce of my Pakistani husband of 4 years of marriage. We have decided to be friends than being married to one another. My husband came here in usa on January 26, 2008. He got his residence card last summer (I think). I am thinking of doing my own divorce without lawyers that would save me money. I want to get my divorce within 90 days. What should I do next? We have no children. We will agree to part our household stuff. He doesn't want much from me. He would want to live here in USA rather than going back to Pakistan. I support his decision and I want us to be in a good terms. He already have 10 year green card since jan 2009.if we divorce he still able to apply citizen in 3 years

see your county courthouse for divorce filing regulations. these vary by state.

if divorced from you he will have to wait until his green card is 5 years old before he can obtain citizenship and apply for another paki wife.

if i say anything more i'm sure to get banned.

There's a small conflict in your timeline. You say he "got his residence card last summer", but you also say he "have 10 year green card since jan 2009". The exact date the green card was issued will determine when he will be eligible to apply for citizenship. If he's still married to you 3 years after the green card was issued, then he can apply for citizenship. If he's not still married to you, then he's eligible 5 years after the green card was issued.

Unfortunately, Illinois is a "for cause" divorce state. There is no summary dissolution by consent, which means you cannot just get divorced within 90 days. You can get a divorce more quickly if you file for cause (impotence, abuse, alcohol or drug use, criminal convictions, etc.). However, many of these grounds could also result in your husband's legal status in the US being revoked. You can file based on irreconcilable differences after you've lived apart for 2 years. The 2 year requirement can be waived by the court if you've lived apart for 6 months, and you both consent to the waiver. You could also consider getting divorced in another state, but most states have a residency requirement of 90 days or more.

I don't think this is going to happen as fast as you would like it to.
