the dates are accurate. The age cut is the difference, under 21, a child of oa USC under 21 is an immediate relative with no waiting time.

a single child of a USC over 21, takes more than 6 years of waiting, married more than 8 years.

My mom is a USC and filed for me, single child over 21. My waiting time from filing the i130 to the interview 5 1/2 years because I had my interview in country due to the 245i law. When you are doing consular process, it takes longer. I filed in October '99 and I got my GC in January of '05

what you can do is go to the university or take some courses, study something that will be useful, you have a long time of waiting.

Thank you Aleful, I have started studying, I thought this forum was to inform the misinformed but some people I guess have chips on their shoulders, cause they are just being rude... I know that I am 3rd preference, but if they took the same time to read as they did to write, they would have realized that I was asking a question not relevant to my own situation but a general question.

I looked at the visa bulletin for visas April 2010, this states that they the cut off dates for 1st preference, is July 2004 and I know of people who were in that category and papers were filed within the last 9 months and they got through, My Question was only for understanding how this works, if the cut off dates are accurate, then how was it so quick for some? NOT FOR 3rd Preference or myself.

You give good advise and thank you, I am have already started studying.... have another 1.5 yrs to go...

are you thinking about the i130? the first form, the i130 may take sooner or later to process depending on the service center. then the i130 is sent to NVC for petitions that will go through consular process, if the person is at their country of origen to wait until the priority date is current. So even if the i130 takes a short time to be approved, there is a number of years of waiting until the priority date is current based on the visa bulletin and country of origen. They just file it somewhere and the process is pending until the priority date appears in the visa bulletin.

for example I was in the first category, in 1999 my i130 only took 5 months for approval, but then I had to wait and check the visa bulletin every month until my priorty date became current, which was in 2004. There is nothing one can do but wait in between.

I am studying Bookkeeping level 1-3, and yes your info has helped, although my friend who is a USC, her mum had the interview and she's got through... so she'll be joining my friend in the US within a few wks. How about you what's your journey like? Apart from the 51/2 yrs wait??

I did do some reading on the NVC website too and I realized that there are a lot more criteria than I was aware of, like it depends on the country you're in, and the no of visa applications submitted from that country etc.

F3's processing now had to wait 9 years for a visa number, which is the best guide you have.

Unless you are from Mexico or the Philippines where it is a lot longer.

So say 10 years from receipt date, give or take.

My whole family is here, parents, my brother and his family. I worked with a family friend as my boss in a Language School/Translation Agency.

Since I had lost residency status, we had to start all over again. I was able to adjust in country because of the 245i law in 2001, by paying a $1000 fine. I had to wait to get my GC to be able to go to college, and in 2008 I graduated with a Certificate in Translation. Currently I'm working full time in a Health Insurance Company. Also I'm hoping to move to Virginia next year.

Now I'm on the next step, naturalization. I have my fingerprints on April 2nd, then the interview. I haven't started studying the questions yet.

Just my life in a nutshell

I was born in Guyana, and came to the UK when I was 13 yrs old... been living here ever since, my mum remarried several yrs ago, as my dad had passed away when I was 7 yrs old, so she's living in Florida and my youngest sister is with her as she was under 21 when my mum moved there... I am hoping to join them sooner or later, by the grace of God. I am looking forward to it as I love it there, I visit every year, but also have a good life in the UK, have my friends here, and also my church which has become a big part of my life... Hi All

Hope you're all well...

Someone asked me a question and to be honest I could not answer it, the question is "If someone files a petition for a relative at what point are they entered on the waiting list for a Visa, is it when they got the approval or from the moment when USCIS receives the petition?

I think it is when USCIS receives the petition but not sure, so I thought I would ask some of you experts about this, since I am not clued up on all the processes and procedures.

it depends if the relative is immediate or not. there are 2 waiting lists, one for the i130 and another for the adjustment, so sometimes it's both.

for example, a sibling's petition can take over 10 years, and some i130 can take over 8 years to be approved, some take less.

Just glanced through the thread you guys have going here. I am the married son/daughter of a US citizen 3rd preference and thought this was going to take forever since when I checked the case processing dates for California it said they are still processing May 2002. I said oh jeez I will never hear from them about this since my priority date is March 2005. If it takes that long to be processed muchless actually getting a visa number. Lo and behold last month I got and approval letter and now I am awaiting further instructions for adjustment of status.

This is puzzling to me as well the fact that it still shows they are processing May 2002 but yet still I got my approval letter already. I am hoping that the visa bulletin will be as mysteriously rewarding as the processing has been. An entire 3 years ahead of my priority date. Would be good really good....

The May 2010 Visa Bulletin had some interesting 'updates' in it, about processing of these types of cases - with some recent info as to 'what we're processing now'. Worth a Read !!

E. VISA AVAILABILITY IN THE COMING MONTHS

Family-sponsored: During the past fifteen months, the level of demand for numbers in the Family-sponsored preference categories has been very low. As a result, the cut-off dates for most Family preference categories have been advancing at a very rapid pace, in an attempt to generate demand so that the annual numerical limits may be fully utilized. If demand for numbers should begin to materialize cut-off date movements may begin to slow or stop.

Dominican Republic: Continued heavy applicant demand for Dominican Republic numbers is likely to result in the oversubscription of this chargeability in June. This would cause the cut-off dates for the Family second preference categories to be earlier than those which apply to most other countries.

Employment-based: Applicant demand for Employment Fourth preference numbers remains very heavy. It is likely that a cut-off date will need to be established in an effort to keep number use within the annual limits. Depending upon number use, this action could occur as early as June. Is this what you are referring too??
