Well...to begin with we are just about to begin the process of applying for a VISA. I leave for the Philippines on February 5 and will meet for the first time February 6. We are both very excited to meet face to face. After I return I will start an official time line of our events. So be watching for that to come.

My question is this however. She has her name misspelled on her birth certificate and her passport has the exactly same spelling with the same error. She wants to change the misspelled name on her birth certificate and has applied for the change, however that is not suppose to be completed until next month. Will there be a problem if the spelling of the name is different on her passport? OR should she just wait until she gets her VISA and arrives in the states to change the name spelling. OR should she change the name on her passport to match the birth certificate. Her funds are very tight...and I will probably have to pick up the cost and my thinking is to just leave everything the way it currently is and see about making the change once she arrives here...anyone else have this problem.

One more thing...can anyone give us anything we need to do during are meeting that will help with our process of getting her VISA? I am really very nervous about my upcoming trip...I fly from the states to Tokyo and then to Manila. I have never flown before so any help with this or things I need to know would be greatly appreciate.

I assume you are applying for a fiancee visa... May take 6 to 9 months... Change her name in the PI (Cheaper and Easier),,, will be expensive and almost impossible to change the name with the Immigration paperwork involved... Or just leave the name as is... The immigration process is not easy or cheap.

Thanks...I have checked out the link...and I am finding out that this is not cheap by no means. Was hoping that the process would take less time...why are you thinking 6 to 9 months? I have read 4 to 6 months. Yes will be applying for fiancee VISA...neither of us have been married and no minor children are involved.

Yes, it can be a problem for the obvious reasons, you should fix the name before you fill out the forms with the correct name if she wants to change it.

I need to clarify this somewhat. On her birth certificate her middle name was spelled Olib and should have been spelled Olive...she has left it this way because of the cost to change. Her passport has her name spelled exactly as her birth certificate is. She wants to change the spelling to be Olive...shoud she just leave it or get both changed?

It is considered misrepresentation if your fiancee knowingly submits a document to the US Embassy that is not correct. Better to correct it now.

First thing she needs to do is to go to the Local Civil Registry and file for correction under RA 9048. For more info on RA 9048 click here http://www.census.gov.ph/data/civilreg/primerra9048.html

Once her birth certificate is amended, she must go the Department of Foreign Affairs for passport amendment.

If she has left it that way and all of her other stuff like school records were spelled same way then it would be better to just leave it as it is. Anyway, I and your fiancée were in the same boat. My middle was misspelled as well (One letter suppose to be "E" but in my Birth Certificate it's spelled "I") but I just followed what's on my BC when I applied for a passport and everything else and didn't cause any delay to get the Visa but of course every case is different and It's all up to you and she applied for name change already so good luck on that. Has she been gone outside the Country using that name? Good luck on your first meeting it very exciting I know… lol.

I had the same problem, when I got my birth certificate from NSO, my bday and my middle name were different from what i was used to use in all of my documentation, I went to the agency and the lawyer gave me an affidavit of discrepancy also known as affidavit of two names but refer only to one person, i just followed whatever was on my birth certificate because correcting names cost too much, and now i dont have any problem though my middle name is different from my moms maiden name. hope that helped.

I had my middle name in my birth certificate as Roben which was supposed to be Ruben so when i got my passport, I just followed whatever in my BC, other mistake was my bday supposed to be feb 17 but in my bc it was feb 16 so i just followed that too, the problem i had was i used Ruben and feb 17 with most of my docs before i got my passport like my school docs so I needed to get that affidavit of discrepancy, if i were your fiance I will keep it that way, less hassle.
