hi again.. im ready to send my AOS application. i just want to confirm if i can send the most recent income tax return of my husband which is year2008? beacuse i cant include his previous income tax returns because i dont have the copies anymore. i sent the original copies when i was applying for my K3 visa in the philippines.

Best thing to do is call the IRS and have them send you his tax transcripts. They're free and it means that you don't need to include the W2's etc. More info on my thread here: http://www.visajourney.com/forums/index.php?showtopic=235331

Yes - you are only required to send in one year (most recent) - you can add more if you think your case can be helped by it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

With the AOS you only need to send most recent year (2008 at this point) and make statements of his gross earnings for 2007 and 2006. However you MAY be requested to bring the 2007 and 2006 returns to the interview so order tax transcripts from the IRS.

NEVER give anything to ANYONE without first making sure you keep a copy for yourself.
