1.) Should we apply for AOS before the expiration of the 1-94?

Mine expires on the 18th of Feb 2010. We already got married and so far I have done SSN application under my married name and should be expecting the card arrival within 2 weeks. We also got certified copy of marriage record.

I have pending immunizations to complete too. One is Td and the other is HPV/anti cervical cancer vaccine. I got the 1st HPV shot overseas (October 2009) and the remaining 2 doses should be completed here in the US. The 2nd dose should be done 2 months after the 1st shot. The 3rd dose should be 6 months after the 2nd dose...realistically, will be able to complete them sometime in July or August, that's if ill take my 2nd dose now too.

2.) Do I have to wait to complete ALL my pending immunizations before going to a USCIS-designated civil surgeon and have the medical records transcribed?

3.) Do I have to wait to complete everything in the medical too before submitting my AOS application? Coz I understand, 1-693 is one AOS requirement.

Main concern is just to make sure we don't miss doing some important paperwork before the expiration of the 1-94 that might put the wife into any immigration trouble in the future like deportation, :no: etc...

You don't need to get the HPV shot anymore. It's no longer required.

1. Yes - apply for AOS before your I-94 expires. Always protect your status!

HPV is no longer required for the immigration process, you may not need to do the remaining shots. Talk to your CS.

2. Yes, you should - if you do not, you might be issued an RFE (but some people report not getting one for lack of this) - (So it looks like you need the TD?)

3. See above.

Going out of status can raise issues with ICE - so I always advise to AOS asap. Once you get the NOA from the AOS, your "covered" - and go from there.

(Like answering an RFE for the vaccinations if needed)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

1.) Should we apply for AOS before the expiration of the 1-94? You technically do not HAVE to but it is wise to do so that you are always sure of your status. You are still eligible to apply for AOS after the I-94 expires but you may encounter issues if you're "caught" because technically you're "out of status"

No you do not need all pending immunisations first. Not to confuse you, if you apply for AOS before you are "due", like in the case of HPV where it's 6 months (though it's no longer required) the CS can still sign off on your I-693 because you have had all immunisations that you are eligible for. However you also stated you need the Td which has no "time delay" so you will need that. Safest thing to do is to go to the CS with your immunisation record (DS-3025) and they should be able to tell you what you need, and then sign off the I-693.

3.) Do I have to wait to complete everything in the medical too before submitting my AOS application? Coz I understand, 1-693 is one AOS requirement. The I-693 is NOT a requirement for AOS, the immunisation portion is only a requirement in cases like yours where shots are not completed in your home country during the K1 medical. Technically all of my shots are complete but people in my situation have still received RFE's, and some haven't so to ensure I don't get an RFE I will still have my immunisations copied over to the I-693 and have a CS sign it, just to be safe. You DO NOT need to have another medical, they only need to copy over the immunisations.

I'm sorry Bob but I must correct you here. The OP has explained the scenario regarding HPV, and though the HPV is no longer required, you advice of "yes you should have all complete" implies that if HPV were STILL needed then she would need to wait until she has received all 3 shots, the waiting period between the 2nd and 3rd being 6 months. This is not the case and is clearly outlined in the CS guides (the ones they use for their rules) that they cannot NOT sign off on someone's I-693 if they haven't completed all shots in the cases where shots are "time dependant" thus holding up the applicants AOS.

I understand you didn't MEAN to imply that because you already stated the HPV isn't relevant anymore, but best be sure no-one misunderstands.

I was talking about the TD - not the HPV.

I all ready stated that the HPV is not needed anymore for immigration purposes prior to that statement. (However, I did mention he should talk to his CS about the HPV, because they may still want to do the shot cycle)

However, I can see how some people might misunderstand the flow of my statements.
