marrying us permanent resident not citizen

Me and my girlfriend are looking at filing to live together and get married. I live in the UK and she lives in the USA except shes not a US citizen but shes a permanent resident. She is going to apply for naturalization but probably not for another 3 months.

Is it possible to file for a fiance visa while she is filing for citizenship? or would it be better to do it before she applies for citizenship or is it even possible or do we have to wait for her to be a citizen. Im not sure of the process if shes not an American citizen.

No. She needs to be a US citizen before she can petition on your behalf. Get that straight first.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

I don't know about legally.

But as far as mental sanity goes, going through the K1 process is stressful enough. Her having to do the K1 AND get through citizenship. Phew! :diablo: Not something I'd wish on my worst enemy.

She has to be a US citizen. If I were her, I wouldn't apply until she is a citizen and has her naturalization certificate since it's required (to prove you're a US citizen).

If you get married in the UK (or anywhere else OUTSIDE of the US), she can however, petition for you as a spouse (it could take a while I hear).

seldi,

No need exclude marriage in the USA - that will work also.
