My husband is here on a student visa. He just finished his OPT almost two months ago so he's going to be out of status next week. We got married June 17th, and haven't been able to get all the info we need to submit the I-130 and I-485. Since he's going back to Morocco I know I can file the I-130 and then the I-129f for him to return. Can I submit everything at once?

Just file the 130 since youre already married.. when you get your first NOA from your 130 petition, you can then file for a K3 visa. K3 visa usually gets settled about 3 months. Once your K3 is approved he can come back to the US as a non-immigrant, apply for AOS and wont have to go back to Morocco.

Try being long distance for 7 years.. Be a strong person :no: .. I know its hard.., you can live apart for more than 3 days.

Timeframes/difficulties for getting a K3 in Canada do not translate to getting a K3 in Morocco.

since when have K3s been at 3 months? it took them 7 months to approve our I-129F 2 years ago :P

The USCIS website currently says at least 5 months for I-129Fs for K3, which unfortunately have always taken longer for people of eastern countries, including Morocco because they do additional security checks. They usually catch up to the I-130s from what I've seen of timelines here.

It is not based on any single factor.

Theres a factor in every case.. could be anything.. could be volume, or time factor. If there is no factor then we should get our paperwork done in a zippy.

We Had an appointment yesterday with immigration. The officer told us that he doesn't have to go back because he is now in C9 status because he in in the US already and he should not go back. So now we just have to finish all the paper work and I don't have to worry about the I-129f at all! Thank goodness! Thanks for all the help and advice!

There's an inconsistency here - in an earlier post you wrote that he has not yet submitted an I-485. If that's correct then he cannot be C9 yet (an adjustment applicant pending decision), although he will be once you submit I-130 and he submits I-485. Are you sure that you and the USCIS officer correctly understood each other?

Not that the final conclusion would change any - have him stay and submit those forms without further delay.
