Hi,

I am a US Citizen and recently got married in India. Due to work at my office, I had to come back to US. I know partly about the K3 visa process but not completely. Does taking local attorneys help and assistance, will it speed up the process as I am not totally aware since applying for the petition what to do? Can someone please guide me which one is better.

Doing the process on our own or taking attorneys help & assistance?

Any responses is highly appreciated and thank you so much in advance for any information.

Thanks,

Tanvee

Not only will professional help not speed the process but the K3 process is not longer faster than the CR1 spouse immigrant visa process. Depending on your own aptitude attitude and devotion, the best a professional can do is help you avoid delays. At worst, they can induce delays.

If you have the aptitude, devotion and time to follow the guides here including the NVC shortcuts, your timeline will probably be shorter doing it yourself.

Best bet for speed and accuracy it to file the CR1 (dont wast time with the K3 as many petitions are held up while waiting approval of both applications at the same time) and do it yourself. This site gives you step by step in the process and how to shortcut as much as possible... A lawyer does not do anything that you cannot do and slows things down because YOU still fill out the forms and they are a middle man that sends them in... USCIS does not care and it does not speed anything up.

My suggestion, a lawyer will complicate the process.. read the guides here, follow the CR1 and dont wast your time or $$$ on the K3

Appreciate and thank you for the advice.

What is CR1?

How can i proceed applying for CR1? What are the forms/documents required for CR1?

I am new to this entire process. Thought K3 visa process would be faster, but didn't knew about CR1. Haven't applied visa for my husband yet, please help me with all the information that I can process for him asap.

Thanks.

If by "local" you mean attorney in India, it is not unlikely that the attorney will not be up-to-date with US immigration laws (basic test-lab of "Sod's Law"). Better to do so on your own, IMO.

(having had a bad experience with a US-based lawyer--who misfiled my employment-based GC petition--and having succeeded with a K-1 petition I filed on my own after being naturalised)

Start with the Guides in this website, you have to devote sometime to complete this process. If you have a simple case, like no over stay or any criminal record or things like that, then an attorney is not much of use. All an attorney will do in a simple case is post the forms to appropriate place; it will be your job anyways to provide with all the documents.

Do read this site, especially CR-1 forum and get a better idea before sending your petition.

Look up CR1 in the guides and get the info... CR1 without a lawyer is probably your best bet. the K3 is obsolete, expensive and does not save time!!!

 The very design of K-3 process was shambles from get-go (ergo never even considered by me as option)--so I "corrected" your post.
