So...I'm all ready to file myI-485/I-130...I'm currently on an H1B visa, and at the last minute I decided to file the I-765, just in case anything gets held up, and I don't get my greencard before my H1B expires...

So, my question is about question 11 on the I-765 form - have you ever applied for employment authorization from USCIS...do I put yes or no??? Is this question refering to whether I have ever filed an I-765 form before, or something else??? I am currently working with an H1B visa, and before that I had a TN visa (I'm a Canadian citizen).

I had a H2B visa and apparently they consider employment authorization as different to work visas. I was told they were referring to if you'd had an employment authorization card before (mostly in F1 OPT/L2 cases) - so I answered `no.' But I included a copy of my visa in with the paperwork - so they could change it if they wanted to. It seemed to work fine as my card was ordered last week - though I am waiting for it in the mail right now... :blush:

Nov 9, 2012 Case Touched, NOA date

Nov 13, 2012 Got text/e-mail with case number & the check was cashed :)

Nov 14, 2012 Case updated online to say biometrics apt. notice is on its way!

Nov 16, 2012 Received NOA & biometrics apt. letter

Nov 28, 2012 Biometrics apt.

Jan 4, 2013 In line for interview!

Jan 5, 2013 Scheduled for interview!

Jan 10, 2013 Received interview letter

Jan 19, 2013 Received yellow letter dated 1/16 asking me to bring more passport pics to the interview

Feb 11, 2013 Interview

Mar 8, 2013 Got an online update - oath scheduled!

Mar 13, 2013 Oath letter received

Mar 22, 2013 Oath! Officially an American citizen!

Hello, I actually answered Yes to the question and then listed the current employer. I also adjusted from H1B and I got my EAD just fine by answering Yes. Good luck!!

1999 Arrive in US as F1 student

2003 Graduated college and found a job - switched to H-1B from F1

2006 H-1B renewed

2007 Switched job, H-1B transferred to a new employer

2009 Engaged

9/22/2009 civil ceremony - I am married to a wonderful man - tall dark & handsome :)

MY TIMELINE

10/05/09 sent I-130/I-485/I-765/I-131 via Fedex to Chicago (Day 1)

10/06/09 Delivered to Chicago, signed by J. Chyba (Day 2)

10/14/09 Check for I-485 cashed (Day 10)

10/16/09 Check for I-130 cashed & received all 4 NOA's!!!! (NOA Date was 10/13/09) (Day 12)

10/27/09 Received Biometrics appt letter (Letter Date was 10/19/09) (Day 23)

10/28/09 Attempt to walk-in bio failed at Wheaton, MD Support Center.... (Day 24)

11/06/09 9AM Biometrics Done

12/03/09 Received interview letter (Scheduled on 01/06/10 in Baltimore) (Day 59)

12/08/09 Received E-mails: EAD production order and AP approval (Day 64)

12/14/09 Received AP (2 copies) in mail!

12/16/09 Received EAD!!!!!

01/06/10 Interview done!!! - 20 minutes of waiting and 15 minutes of interview

01/21/10 Got Green Card in a mail!!!!!!!

01/26/10 Got Welcome letter saying my green card is approved (got it after I got my GC:) )
