Currently i am living in Brazil on a protocol (temporary permament resident), I received this protocol after my wife and I were married in Brazil in 2009. Living on a protocol was the only way for me and my wife to stay together while we wait for the immigration process to conclude as a tourist visa would expire and i did not qualify for a student or work visa. I have filed an immigrant petition (IR-1) for my wife, we filed it in the United States. I view myself as having domicile in the US even though i am living in Brazil on a protocol. I continue to work for my US employer virturally and travel to the US quarterly for work. I have no financial ties to Brazil, all ties are in the US as my plans are to move back there with my wife after the 1 year of residence in Brazil

I feel this might be conflicting in the eyes of a US Immigration official. Do you know how the US views individuals living abroad on a Visa/Permanent Residence while still staying domiciled in the United States? I don't want this question to come up in the immigration interview and not know how to answer it and also want to be truthful in my response.

Any thought or previous experience would be helpful

Hi, my husband is living with me in BR as well. We'll have to apply for his residency next month as his visa is expiring. I never heard of anybody getting in trouble for living here while the visa is being processed.

If they ask us why we don't just stay here once he has a permanent residency we'll answer that he tried to live here for a while but is under hardship. I don't think the CO will interfere in your decision of where you want to live though.

If he does, just say the truth. It's your right to decide where you guys want to have a family.

July 30, 2010 - Received the Green Card after receiving 4 welcome letters! USCIS see ya later!

2 YEARS LATER......

03-02-2012: Elegible to lift conditions
06-02-2012: Temporary GC expires

12-20-2012: Permanent GC received

6 MONTHS LATER......

06/03/2013: n400 Filled

10/22/2013: Citizenship test and oath ceremony
