I am filing for a K-1 VISA and my fiancee may be losing his job of 7 years. We are at the NOA 2 stage so we are wondering if our I 134 gets denied, can we resubmit with a co-sponsor? He has assets (including his house, and savings that should be sufficient, but his job is downsizing and he may lose his job between now and the time of my interview at the embassy. We would like to avoid using a co-sponsor, but we also dont want to run into problems if we submit the I 134 and it does not get approved. Does anybody know what happens if your I 134 is declined?

2009-09-15 : I-129F Sent

2009-09-16 : I-129F NOA1

2009-09-19: Check Cashed

2009-12-22: I-129F NOA2

2010-01-07 : Consulate Received

2010-01-22: St Luke's medical exam

2010-02-01 : Interview Date (Approved!)

2010-02-06 : Visa Received

2010-02-15 : US Entry

2010-03-04: SSN received

2010-05-01 : Wedding day!

Comments : smooth sailing, thanks visa journey!

AOS timeline:

2010-05-06 : AOS package sent

2010-05-07 : received and signed (USCIS Chicago lockbox)

2010-05-13 : check cashed

2010-05-17 : received NOA1 in the mail for I-485, I-765 and I-131

2010-06-23 : received approved I-131

2010-07-01 : received notice for biometrics on 7/20/10

2010-07-20 : biometrics done

2010-07-21 : I-765 Employment Authorization approved! Card production ordered

2010-07-30 : I-765 Card on hand ( wohoo )

2010-09-03 : Interview sched (had to resched coz we're out of town)

2010-10-18 : Interview...approved with no problem! card production ordered (YES!)

If it not acceptable, then they will usually allow you time to correct the issue (getting more info, co-sponsor, etc..)

However, your embassy is a bit touchy with cosponsor's at this stage.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Nothing prevents the petitioner from executing the I-134 now, while still employed. The information is expected to be current as of the date of signature.

The same thing happened to me. After I filed the I-129 I was laid off. Her KI VISA was approved. She arrived and we got married. While I collecting unemployment insurance + using any W2 income I filed for the AOS I-134 and it was approved. Now on Feb 8, 2010 we have our final AOS interview and I'm still unemployed. Some people with the same issue as me I've read on VJ were approved without any problems. If anyone was denied their AOS because the petioner was unemployed at the time of final AOS interview I have not read about it on VJ. I will let everyone know what happens to me.

Please do, as I have yet to hear of a success with visa or AOS from a petitioner whose unemployed status was actually known by the decision maker.
