So my husband was refused his CR1 visa 12/15/09. 

-----The applicant has been found eligible under section 221g on the immigrant and national act. This section prohibits the issuing of the visa to anyone who’s application does comply with the INA or regulations issued pursuant there to. We will return all case files to the NVC who will than transfer the case to the USCIS......The USCIS will contact you as soon as they receive your petition. Please do not contact the embassy regarding this case. It could take up to six months for the case to be forwarding.---

I was so upset and mad because it took a year and a half with the NVC and that was with rushing it to be scheduled. They told him our marriage was fake and someone must have paid me to marry him. So I go to the embassy and demand to speak to someone. After about an hour a man came to the window and said he would review my case. He said he was second in charge. He called me in the room behind glass and just grilled me and demanded the marriage was fake. This was my fifth trip to Ghana. Now after the Nigerian boy tried to blow up the plane it will just be harder to get a visa. They will think all Africans are extremists. I must of watched this man deny like 50 visitor visas while I sat there. When I flew and passed back threw Amsterdam the questioned me and asked my husbands name and if he hates America, don't get me wrong all passengers were being asked crazy questions. I am ok with this cause I want to be safe from radicalists. But I am so fed up with the embassy I am ready to give up on my husband. I love him very much but I am so stressed all I do is worry and spend money. Now I only wonder how long an appeal will take! More time. More money.

I'm sorry his visa was denied. I'm not sure what the timeline of events are for you, but if you want to appeal you have to do it before they return the petition to USCIS. IT seems as though you were able to do this to some degree already since you were interviewed. You should consult an experienced immigration attorney. What were the reasons they said your marriage was a fake?

But before you do there are a few things to consider. The consulate may have information about your husband that you do not know. For example, perhaps he applied unsuccessfully for a K1 before, or even multiple times. I don't know you or your relationship. But if there has ever been anything about your husband that seemed to be a cause of concern for you, the denial might mean that there is some substance to concerns that you have dismissed.

But if you are confident in your relationship you have many other options. (1) If he was not banned from the US (if he lied during the interview, he might be banned for life....look at the denial notice carefully) you could re-apply. Consider this carefully, if you've visited him 5 times and sent reasonable proof that your relationship continued while you were in the US, I don't think the results would be any different. (2) You might be able to move to Ghana and do Direct Consular Filing...you can read more about it on VJ and find out of DCF is available through Ghana. I think you might have a better chance going this route because you will be living together and you will have the history of the denied CR1, followed by moving to Ghana and re-applying. (3) Also, the 2 of you could immigrate to a 3rd country and start new lives there.

All of those suggestions will take more time and more money. I hope you find a solution that works for you.
