we got married at the end of November and we are in the process of sending off for the AOS....I am confused as to what we are to send off and what we are paying...I read on here you do not pay for the I-131 & I-765???!! but I am not sure......

Payment(s) as required by USCIS. Be sure to include the payment for both the I-485 and the biometrics fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead. >> The fee for I-485 applications filed on or after July 30th 2007 inlcudes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007).

Also if we are to pay for it separately is it worth paying for the I-131 as I am to believe when you get your green card it is not valid anymore??? or am I wrong can someone please explain it to me....and what is the time expectation for getting the green card? My Canadian wife wants to visit back home so should she get the Travel document or just wait for the GC???

No charge for AP (I-131) or EAD (I-765) when filed along with your AOS (I-485). Go ahead and file the I-131 (although it is possible to get the GC before the AP)

Also, "new fee" for AOS is $1010, it's not actually "new" anymore, it's since July 2007. There's no changing that fee, whether you don't apply for EAD or AP, you will still be charged the same price. Previously, the fee didn't include the EAD or AP and you had to apply for those (and pay for them) separately.

If you apply for EAD and AP at the same time as AOS, it's simply an extra form or two (not a lot to them) and a few extra photocopies of things you're already sending so it's not a huge hassle. The other thing is, sometimes (not always) AOS can take longer than 3 months, but during that extra time the EAD will allow you to work, and the AP will allow for any international travel in case the need arrives (fingers crossed it's not needed, but you know you'll need it if you don't have it).

So I just send in $1010? and fill out the paperwork for the I-131?? I dont want it getting sent back....she came on a K1 before we got married if that makes any difference??

You will send in the paperwork (and supporting documents) for AOS, EAD and AP at the same time, with the ONE fee of $1010.
