Hi. THis is me Laurie here. I am from Illinois. I wasn't too sure how to proceed my divorce of my Pakistani husband of 4 years of marriage. We have decided to be friends than being married to one another. My husband came here in usa on January 26, 2008. He got his residence card last summer (I think). I am thinking of doing my own divorce without lawyers that would save me money. I want to get my divorce within 90 days. What should I do next? We have no children. We will agree to part our household stuff. He doesn't want much from me. He would want to live here in USA rather than going back to Pakistan. I support his decision and I want us to be in a good terms.

Should I file to remove conditions from his residence card that will proceed our divorce or what do you suggestion? I'd be very grateful for your help. Your input is appreciated.

Divorce laws are governed by your state of residence... google "Illinois Divorce laws" (or something to that effect) and see what comes up

need more info. If you have been married more than 2 years by the time GC granted he shouldn't have conditions on his card at all.

You can get divorce and he can file seperately (ROC) as soon as the divorce is finalized

September 5th 2007 Married in the U.S

October 15th 2007 documents were recieved

Nov 25th 2007 biometrics

Dec 17 2007 work authorization

Feb 26 2008 interview and approval

25 Nov 2009 I-751

27 Nov 2009 NOA

11 Dec 2009 Biometrics (early bio)

31 Dec 2009 touch (web site indicates last update)

Looks like there's 2 issues here.

1. Pro Se Divorce

2. Removal of Conditions

Pro Se Divorce is fairly simple in Illinois. You'll file (search the 'Net for format) and be given a date for prove-up in front of a judge.

You'll need to have a fairly extensive settlement agreement that covers children (although you have none, you may need to make a statement that you are not pregnant, etc), division of property (real estate, cars, DVD players, bank accounts), division of debt, and ongoing spousal support or the joint decision not to pursue such.

As for removal of conditions...knowing that you're planning to divorce, but continuing to sponsor your foreign spouse, could be considered as fraudulent.

Your spouse may or may not be able to attain a 10 year GC without filing a joint application, but there is no good reason EVER to commit fraud.
