Biometric Appt after filing paperwork

Quick question:

My wife (the non-US citizen) is planning to leave for her home after we get the acknowledgement letter for her paperwork. She's got an academic project at home that will keep her there for about a month but might extent to two months.

My question is how likely is it that she'll need to be here during that time frame for her biometric appointment?

What paperwork did you send in?

According to your timeline - you haven't sent in the AOS paperwork.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

According to your timeline - you haven't sent in the AOS paperwork.

but based on the K-1 timeline I hope this is ROC as the K-1 timeline is many years old.

OP: Biometrics is typically about 4-6 weeks after submission depending on location.

Sorry, didn't update my timeline very well. Her conditional permanent residency is about to expire on Feb 23. I'm preparing to send in her I-751 this week, but she was planning to leave for home at the end of Feb for a month or two.

Is this feasible, or should we wait for a certain milestone?

Not the answer she was wanting, but thanks nonetheless :) She's getting homesick and has been freaking out lately about not getting to go home soon enough. Still better to wait than to not be able to come back.

If you send it now, then you might get your biometrics appointment before she leaves. It is risky because if delays happen, or the ASC you go to is busy, then the appointment will be later, which may conflict with your plans.

I would suggest you play it by ear on this one, and see when the biometrics appointment is. She can also try to do a walk-in and get it done before she leaves, as long as she receives the bio letter.

Some people do get requested to go for a second (sometimes a third) biometrics as the first one didn't print clearly, so there is some risk with being out of the country during a pending application with USCIS.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

While this didn't happen to us, I can see where it could have. The lady tried 5 times before she got good prints from Kanti. Her fingers are just about smooth :)

I left the country after filing. I figured if the appointment came in and I missed it I would just reschedule. You can always open the letter and if it's scheduled for a time when she's unavailable, you can reschedule. Alternatively, if the appointment notice comes in before she leaves, have her do a walk-in.
