We received our NOA2 for a K1 visa almost a week ago, now we're collecting all the docs for my interview at the US consulate in Naples, Italy.

My fiancee doesn't earn enough to reach the poverty line (she's a student and has a part time job) but she's got money in a savings account that would be more than enough to comply with the 3x1 rule (or 5x1 required by our consulate in Italy).

is it alright to go just like this, or should we preferably get a co-sponsor within her family?

Also, is the 3x1 or 5x1 rule applying to the USC's assets only for the difference between her actual income and the poverty guidelines, or for the whole amount?

If the sponsor's income falls short then the assets could be used to make up the difference using the appropriate ratio.

The CO can use their discretion regarding the sponsor's affidavit. So there can be no absolute answer.

It's usually the difference that you have to cover.

(short 2000, must have 6000/10000 in savings (3x/5x)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you for your reply.

I have a couple more questions: must the signature of the USC on the affidavit of support form be notarized? I read somewhere that it's not mandatory, but I'm not sure.

Also, do they ask the incomes to be 125% of the poverty guidelines or just 100% at the visa stage? I read somewhere that the 125% rule only applies for the AOS phase. but again, not sure.

Thanks again.

Depends which I-134 you are using - the older one requires it to be notarized - the newer one does not.

125% is usually what they look for (some embassies are different - but most are 125%) - so I would figure and prepare for 125%

(moved from K-1 to Embassy - more related)

I guess I will find the form in packet 3, right? It should be the newer one, unless they send me an old and not updated form.

I didn't notarize my I-134, because it's a "recommended" not "required" form at the embassy we're getting processed at anyway.

Depends on the embassy.

Ankara references the old one (in the instructions for the K-1), however, when asked via email, they said "download the new one and you will not need it to be notarized".

You could always use the most updated form from the respective site (USCIS/STATE)
