File Joint Tax return?

I was going to be filing my papers in a couple of days but i just figured i might as well wait and do a joint tax return with my husband instead of having to do a revised one down the road. So I know i can file with him but does anyone know how? Seeing as i don't have a social security #???

My understanding is that you leave the ssn area blank for him and you attach a w9 for him to your return. The IRS may assign an ITIN number if he does not qualify for an ssn yet.

But I'm sure other VJ'ers who have already done this will provide a better answer. or You can call 1800 IRS 1040 and speak to a representative who can give you the best way to approach this.

I should have made myself more clear it is me without the ssn and he has one my bad.. Thanks for the answer though. what is a w9?

I'm assuming you are talking about filing a return in the US.

The W9 is the form that aliens fill out in order to get a taxpayer Identification Number(TIN). If there is a joint account in the US that is interest bearing, the W9 should have already been filled out and an ITIN number assigned by the IRS. If you already have an ITIN number then that number is used instead of the ssn for aliens that do not qualify for an ssn at the time of filing.

You will be best served by visiting the IRS website at www.IRS.gov....or calling them. They are more than happy to help you out. You can also download the W9 form from the IRS website.

Does your husband have his W2s for 2009 yet? & if so is he ready to file? My husband just got his W2 (which is pretty early) but i don't have mine yet - they usually don't arrive until late January/early Feb. I believe by law companies are meant to mail the W2s (which you need to file taxes) by Jan 31st. So if you filed your AOS like this week - I don't believe USCIS would expect you to have filed taxes for 2009 yet since most people wouldn't have their W2's yet - especially as you have until mid April to file 2009 taxes anyway.

If I were you i'd mail the AOS (asap - get that process started) with his 2008 returns - as that is the most recent year the majority of people would have tax returns for at this point. Then you have until the middle of April to file 2009 taxes (without getting an extention). By April you'll likely to have got your EAD so you can then get a social security number - you won't have to worry about the ITIN. You can then take your 2009 return to your interview.
