If you cant get an infopass appointment you could try doing a walk in.... you may have to wait a long time but you need to act on this quickly or you will get a denial for failing to attend....

You may have to file a motion to re-open your case or you may be quicker filing all over again....

Yeah. Most offices take walk-ins. I would show up early though.. like 4 or 5 am.

I would write the letter to the USCIS, as recommended by them, as well as visit the Alexandria office..

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Sorry to hear about your situation. Sounds like a solution is on the horizon, though it may take some time to sort it all out.

If it makes you feel any better, I recently read about a K1 couple who filed their I-129F petition and then, a couple months later, got married... :mellow: ...and continued waiting all the way up to the Embassy interview, at which point the CO advised them of their error. I suppose that, somehow, the term "fiancée" escaped their notice. :blink:

So the couple is looking at up-to an additional year of waiting whilst the sponsor initiates a marriage-based visa petition (need to start from Square One).

In any case, my condolences and I hope that your situation is resolved quickly. :thumbs:

Update: yesterday I went back up to the local USCIS office less distraught and was helped almost immediately by a reassuring woman at the information counter. I told her what had happened and she agreed about sending the letter. I asked her if I could hand-deliver a copy of the letter and she said they can not accept that... something about needing a post-mark on it... and so I said I would go over to the regional post office (major facility practically across the street from USCIS) and mail it. She told me not to worry, that they would give me another appointment. I asked her if our file would still be there and she said when someone misses there appointment, their file goes on a certain shelf and they wait to hear from that person. If they get a request, they reschedule. She said to go ahead and mail the letter at the post office and then, if we don't hear anything within 30 days, make an infopass appointment to find out what is happening. I told her I had tried already to make an infopass appointment and hadn't had any luck. She had a couple of suggestions about making an infopass appointment. I also asked her about my reason for missing the appointment (that it wasn't "compelling") and she said something like "Don't worry, it was an honest mistake and we all make them. I make them a lot <laughing> They'll understand." She was really nice and sympathetic. So then I went over and mailed a second copy of the letter with the appointment notices and went on my way.

Feeling a lot better today.... just exhausted from all this sturm und drang. Now I am wondering how long I can restrain myself from making an infopass appointment. 30 days? I think not. :no: And my husband's and son's medicals were done last August, so perhaps the punishment for this grievous error will be repeating the medicals. Well, whatever happens, we'll deal with it. The worst thing now is just feeling like I've let my family down...

So glad you are feeling a bit better today.... Its unlikely they will ask you to get new medicals done as the rules are that it has to be less than 1 year at the time you file for AOS not the date of your interview....

I hope you hear something from them real soon....

I hope you get rescheduled really soon. Don't worry about your mistake and don't beat yourself up over it. You are human and we all make these kind of mistakes. I am very ####### about things so when I make a mistake it's like the end of the world but you just have to remember that EVERYONE makes mistakes. They will understand what happened and you will be fine.

I'll never forget when I got my first full time job and forgot to set my alarm clock the night before lol. I wake up at 10am to the phone ringing and my new boss is asking why I am not at work.

We all mistakes so don't let this get you down.

That is very good news about the medicals. I hope they know about that rule!

Canadagirl, I am loathe to describe myself as ####### (which probably means it's true), but admittedly that's how I think I've been about this process up until now. I've redone forms many times and had my husband redo his applications (157 etc...) for the Consulate several times and keep faxing them to me to proofread (which was not as easy as it sounds where he was). After three revisions, I finally realized that between his typing and that of the "professional" typist he later engaged, it just wasn't going to happen the way I thought it should. So I did all the forms myself and FedEx'd them to him to sign and submit. And then after all that to miss the interview.... well, I'm still sick about it. Thanks for sharing your alarm clock story, though. I do need to lighten up and get over this.

And now I have to be patient. Ha. :clock:

I know you said that you called 800# but did you tell them to pass the information on to reschedule, also? I am always doing things like that, I'm usually the one hardest on myself. My family is already used to me forgetting appt's, keys, papers, kids, etc.,

following is taken from: http://www.uscis.gov/graphics/services/ncsc.htm

"Request for Emergency Rescheduling of an Appointment

Please make every effort to appear for your scheduled appointment for fingerprinting, interview, or other processing. Failure to appear can delay processing of your case, and can result in your not receiving the benefit for which you applied. However, if an emergency arises and you absolutely cannot make your appointment, call the NCSC to request rescheduling. The NCSC will record the information, and pass it on to the local office, which will make the final decision whether to reschedule your appointment."
