I am new to this site but very interested in any information i can get about the AWA. I am currently a level 2 sex offender my crime was supposedly commited 11 years ago i did 30 months in state prison and 2 years post release i have not been in any trouble since besides a seat belt ticket i did the counseling was released early and even got asked to come back to a couple groups as a guest speaker i did thousands of dollars in texting and interveiws with doctors to prove i am of no threat to my wife but have been denied to the bitter end my next step is to take it to federal court anyone with information on this what else i can add or a good lawyer please please contact me asap i have 60days left to file THANK YOU SO MUCH FOR ANY AND ALL INFO YOU CAN GIVE ME!!!!!!

I am an AWA filer, with no response as of yet. Can you give us some detials of your case? What were you charged with? (if you don't mind answering)

Also do you have a time line? Or can you tell us if you are married, or trying for fiance' visa? When did you submit the papers and did they deny you flat out, or request for evidence first?

Also note, the adam walsh act, is an ex post facto law. The constitution states that no ex post facto laws should be passed.

Regardless of how well everything else was for you, if they got any idea of your feeling it was supposedly a sex offense then that will prevent a lot of things from happening for you.

You haven't explained why you use that word but it does give anyone reading it the impression that you have not accepted responsibility for the crime and in the world of Sex Offenses that is a big no-no.

The logic goes like this: If you don't accept responsibility for the offense then you can't be rehabilitated.

i did take responsibility for something i didnt do but it was called a plea bargain and i didnt know it would mess my life up so bad or i wouldnt have taken it as far as they know i did and do take responsibility i never once led them to believe any different

I'm so sorry to hear that you were denied even after you sent psycholodical evaluations!

As far as I understand, you have 60 days period to appeal them? Do you need to file in Fed Court for an appeal, or there are lover institutions? Actually, IMHO, Fed court may be a best options, because seems like you didn't prove to be not a risk in USCIS eyes and you have only 1 chanse to do it! But you crime expired 11 years ago, long before AWA! Good luck there! What is your lawyer saying?

Let me ask what did they state as a reason for a denial? There should be a specific reason!

And what proff besides psychological exam did you send?

You are level 2, so are you a subject for registration? For how many more years?

And finally, what petition were you filing?

AWA has hard time recently in fed court. I wish you all the best!
