hello everyone,

I live in Turkey. I have us citizen wife. We are married for 5 years. We had son here. But my wife is now in US with my son for one year and my wife is working there. My wife will file for IR1 visa for me. I have 2 question:

1- We are not sure about IR1 or K3 . I read here. Most does not reccomend K3 becouse of costing more and dealing with additional steps. But some thinks K3 becouse it is faster. I just wanted to get your advise for our case.

2- we lost it our original marriage certificate. My wife has copy of our marriage certificate. I have, too. I can get new one in Turkey. But I concern about that. Becoue what my wife will send with I-130 and what i will take consulate wont be same. Ofcourse informations will be same but the book will be diffrent. What do you reccomend ? can it be problem for us ?

IR1 ALL THE WAY.... DO NOT EVEN CONSIDER THE K3 at this point!!!! The 10 year GC will be granted upon entry and it takes about the same time as the K3 AND costs less!!! K3 is obsolete!!!!

As far as the marriage cert. you only need to send a copy with the I-130 applicaiton... the Original (certified copy with the registrar seal) is taken to the consulate (I beleive you are DCF correct??) Do not worry about the difference, it will be fine

Yup, I'm with christeen on this one. Also, with the IR-1 you are eligible to work immediately upon entry and don't have to worry about EAD.

Another in agreement. :thumbs: I think you will find most would recommend the IR1 route. The K3 does not seem to be any faster so in the end the IR1 has the advantage of immediate eligibility to work and less $$ spent. Good luck.

thanks for your advises

mine is not DCF christeen, my wife is in usa now and i am in Turkey, we used to live 5 year here but we did not plan to move but now my wife and son there. I have tried turist visa for quickly go there for short time becouse of my job here but they refused it now she will file for greencard but we are in a point to make decision what type (i know we are late )

Still the same visa, just start the process by filing the I-130 from the US... Then your on your way with the IR1

how much it might cost for my wife side.. becouse she has just moved a new house and she might need my financial help. i know the cost for "IR1":

petitioner (my wife) side

I-130: 355 $

I-864: 70$

Total : 425 $

is there any fees i dont know ? or any hidden fees ?

i will send the money by western union and as you know the as the amount of money is sent increase as the commission of services decrease. therefore i dont want to send money each time small amount. 500 $ will be ok for her ?

You also have the fee for the IV processing; $400

Plus the medical fees (depending on the country between $150 - $250)

And any DHL or documents you need to send and/or copy...

If you qualify for IR-1, you'd have to be insane to consider the K-3.

i was asking petitioner (my wife) side's payment amount . i think the fees you mentioned are related to beneficery (me) side (i need to do in Turkey), right ?

there is statement in "INSTRUCTIONS FOR IMMIGRANT VISA APPLICANTS "form from our consulate web site:

(The fee for an immigrant visa is $335.00 and $45.00 surcharge per person. You will be required to pay the application fee of $335.00 and $45.00 surcharge at the time of your interview. )

is this payment you meant "IV processing; $400" ? or different something i dont know ?

When you process IR1, everything is paid either to USCIS (the initial $355 application fee) or NVC ($70 for AOS and $400 for IV fee), there is nothing paid at the consulate... You pay everything by check with the initial application then by electronic payment from a US bank account when at the NVC stage. Only the K3 is paid at the consulate but if you go IR1 everything but the medical (which is paid directly to the medical facility) is paid up-front... You can also do check or money order, but electronic is MUCH quicker

The IV fee is paid stateside to the National Visa Center BEFORE the case is sent abroad.
