Leaving USA after arrival using K1

Timeline

Hello all,

I have a family reunion cruise in USA sometime in June or July that requires a passport.

If everything goes to plan, my fiance will be here sometime in February.

I believe she needs to have her green card before she can leave the country and be able to return. If this is the case, how long will it take to get her green card after the marriage?

Could take anything from 3-6 months.

Hi Charlie...welcome to VJ...

Our fellow VJers will correct me if I am mistaken about this, but I believe that your future wife will not need a Green Card in order to travel outside of the United States. I believe she will simply need her Advanced Parole (AP).

After you get married, she can apply for AP when she applies for AOS. There's no extra charge for applying for AP. At the same time, she can also apply for a work permit(EAD). There's no extra charge for that either.

She will receive her AP and her EAD before she receives her Green Card.

So, since you are cutting it close on time, you might want to think about getting married soon after she arrives, and filing for AOS and AP as soon as possible.

In our case, we filed for AOS, AP, and EAD on May 20. My wife received her AP on July 9...less than two months after we filed. On the other hand, she did not receive her Green Card until September 8.

I think there's a very good chance that your sweetheart will be joining you on the cruise.

if the family reunion cruise would only be within the US, then she dont have a problem even without a greencard. Verify the route.

To prevent anxiety, after her arrival, get married and apply for AOS by february. And pray for approval ASAP.

See my timeline, I applied march and got approve may, got my GC by June. Delay was due to new GC machine USCIS need to install before they did production.

The AP usually arrives within 90 days of receipt of the I-131 (AP) in conjunction with the AOS. If you have applied for AOS and the AP has not arrived to go on the trip you can make an infopass appointment and ask for the AP.

The AP is needed for a forecasted trip out of the US. It is not limited for an emergency.

Applying for AP is a routine part of applying for AOS. You can apply for AP at no extra charge, and it's not necessary nor required to say that it is needed for an emergency. Also, you don't have to tell them when you expect to use the AP.

edp333 brought up a good point. If you applied for AOS but did not apply for AP, you can always make an Infopass appointment in order to get your AP. Maybe this is where you heard about the "emergency" stuff...if you need AP but don't have it, the reason you need it is most likely because of an emergency.
