Refusal & green worksheet gave after interview... please help

Please help

My fiance went to the interview and they gave him refusal & green worksheet;

Refusal letter it says;

the office regret to give you a visa because you are ineligible to receive visa under section 221;

1. please submit your original birth-certificate

2. your fiance baby birth-certificate

3. form I-134 from your fiance (sofia)

4. your case need AP may be it will take 1 to 5 months

Why they asked for 4 document while they gave him a white refusal sheet

Is any one have same experience with interview???

I was living with my fiance in Amman, Jordan but because I was pregnant and no hospital in Amman will agree to take me without a marriage certificate so I traveled to USA to deliver my baby here, but unfortunately I dont have any family or friends in USA to help me so I was expecting my fiance to come this month, now I deliver my baby with a C-section and I need my fiance to take care of the baby through my recovery ....... please help shall I give up and go back to Jordan or wait?

Seems like he is not denied yet. Just try to send the missing papers asap and they will probably issue him his visa.

As fast as you send the papers, faster he will be there with you.

ya, give them what they ask for, also suggest a cover letter detailing what is included .

As for your personal stuff of 'where to live' - I suggest you get that baby a passport, and get back to Jordan.

Seems like he is not denied yet. Just try to send the missing papers asap and they will probably issue him his visa.

As fast as you send the papers, faster he will be there with you.

My baby still in the hospital i delivered him on 7 months of pregnancy, I want to go back to jordan at least i can be with my fiance and family but the doc said his immune-system is week now you should wait because its 22 hours flight.

But I can not wait i am still living in a hotel and spend all my saving i was expecting my fiance to come and find a job here but unfortunately nothing work all because of the visa

You better have another income plan - because if he is approved for the K-1, your looking at 3-6 months before he can work upon arrival (that is with an AOS - which costs $1010.00)

Also - since they need an I-134 - do you make enough income to support 3 people at 125% of the poverty level?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Currently I am not working but my fiance has an uncle here in USA he is already sponsoring him & we attached it to my case, I dont know why they asked me for I-134 and they know I am on maternity leave and I ve been more than a year not working

I'm guessing they asked you for an I-134 because you did not supply one.

A Co-Sponser I-134 is not sufficient - there must be TWO I-134s - one for you (PRIMARY SPONSER) , one for the co-sponser

As for living in hotel - hey - get back to the hospital, talk with a social worker - they can find you a cheaper place to live near the hospital (happens ALL THE TIME - is something they can do for you ).

alternatively - you can find temp housing on craigslist - see

pick your state in the right panel, then pick your city.

you can POST something also, I suggest:

1. close to hospital

2. private room with bathroom/kitchen priviledges

3. internet access

you should be able to get something in the 300 to 500/month range, perhaps with a deposit.

Alternatively, go back to the hospital, find the doctor that manages the interns, tell him your situation, ask if he/she knows of temporary lodgings that the interns might use, close to the hospital. I feel strongly, if you can explain yourself to that doctor, they can actually put you up in some dormitory for free or almost free, and it will be close to the hospital.

Now, I AM NOT A DOCTOR, nor do I play one on TV, but - I suggest to you, you'll need to wait about 3 weeks for your baby to grow stronger. I strongly suggest breastfeeding as well - talk to the charge nurse at the infant section about setting up a schedule for you, about breastfeeding. That baby will grow stronger from your breastmilk, quicker than WITHOUT it.

sorry, I forgot to add.

Since yer on maternity leave, from a company -

you still have a job, right?

get an employment letter from the HR department, on the company letterhead, signed by the HR person - stating:

1. your job title

2. your annual salary amount (this is important, don't have it listed as hourly )

3. your date of hire and

4. the fact that you are on maternity leave, with an expected return to work date of __/__/__ .

Include this employment letter with YOUR I-134 packet. If you've not worked in a while, then suggest you get IRS Transcripts from the IRS website or call in, as well.

Thank you very much, I really appreciate your advice, & I already tried to talk to social service in the hospital but they can not help me with finding a place, i am receiving already help from social service food and cash which is good.

something about social service at the hospital. ask every day - as the staff changes - is not the same person each time. at some point, you will find 'the smart one' that knows all, can hook you up with everything that you need.

I feel bad for you, is two huge problems to handle at once..

keep trying to find the doctor that manages the interns, though - he has other connections at the hospital, and also other places.

Jordan embassy is rather tough on the K1 (speaking from a bad personal experience).

I will keep you in my prayers and get those papers to them ASAP!

We ended up getting married and refiling ... thanks to the K1 interview my husband had!

Your fiance went to the interview unprepared and what happened was entirely predictable and should have been expected. The consulate does not care that you made a baby before getting married and having your fiance/husband with you.

Get the needed documents, put together the I-134 (or get a co-sponsor) and get back on track. AP at MENA consulates is typical and many times takes much more than 5 months. Your family size is now 3, not 2. The guidelines for the poverty level increase March 1 and take affect in the consulates April 1. They will take affect for the AOS process March 1. I do not know what they will increase to, it is always a surprise.

You need to submit your original birth certificate, the baby's birth certificate and fill out the 134, that is the first things to satisfy their requirements. Even though you do not earn enough and have a co-sponsor, you still MUST submit that...

Once you get that back on track, check craigslist or look for a "weekly" efficiency apartment or extended stay hotel that rent by the week with a kitchenette. In a few weeks when the baby is strong enough you can return to Jordan...

You will need to think of an alternate plan for income since your fiance will need to adjust status and apply for work authorization so it will be a few months after entering the USA until he can work...
