Hello guys,

Just have a quick question. Do you get the result right after the interview? My wife is about to have an interview on May 18,2009 for your N-400 Application. I wonder if we could file my green card for me as a spouse(me) of a citizen (my wife) right after my wife interview or not ( I would not prefer filling my application when my wife is still a permarment residence)? Time is very critical for me now. I need to get the receipt of my green card application before June 6 to be qualified for an in state tuition fee at my university in this summer. I would appreciate it if someone could give me advise?

Your wife is not a citizen until she takes the oath... some people take the oath on the same day, but no one knows until you are done with your interview. Once the interview is done, the IO should give your wife a form (N-???) and it should state that she passed her civics and English exam. Some people wait a couple of months for the oath (just to give you the heads up).

In anycase - I am not sure what your status is but it certainly is not a permanent resident until you pass your Adjustment of Status phase... so I am not sure if even applying for GC for you will help... someone more knowledgeable will be able to answer your question. You should also check with the university/college and see if the NOA of adjustment of status is good enough to qualify for in-state tuition.

Thanks for your response. I am currently a F1 visa student. I did go to my school and asked for the requirements that I have to meet to be eligible for a in-state tuition fee. Basically, They require two criteria, A receipt of my green card application and we need to get married in 1 year. The issue here is that I want to graduate in summer 2010 ( there would be no problem with my tuition fee and green card applicationif I graduate in Fall 2010). I am trying to save $2,200.00 from my tuition fee If I can get a receipt of my green application (which I refer my wife residence status is a citizen) before June 6. It looks like time is playing around me since my wife have an interview on May 18th. I do know that the USCIS require the citizen certificate from my wife but there is another way I am thinking about to work around with my tuition fee. Can I just send my green card application with the passed paper from that office( assume my wife pass on the interview). Do you guys think that the USCIS would send me a receipt and a request for additional document/evidence to prove that my wife is a citizen <-- there should not be any problem at that time since I get the receipt of my application and my wife will get the citizenship certificate sooner or later. Any other ideas are all appreciated!

This is what usually happens. Once your wife takes the oath, she will receive her certificate. A copy of it should be enough, obviously, to prove her citizenship when applying for your AOS. USCIS, upon receiving the AOS petition, will send you a Notice of Action for Adjustment of Status. If your college is satisfied with a copy of the NOA, then you won't have to wait until they approve or request evidence.

As I mentioned earlier, some people get to take the oath on the same day but if the IO doesn't offer that, make sure your wife asks about the Oath and tell her to ask the IO if he can find out when or even might be able to schedule it for her... some IOs are helpful and they do a couple of extra steps...

One thing you can do - and I am not sure how much money it will be, is for your wife to apply for you now, and then later on reapply when she is a citizen. The net result could save you some money... but the timeline is so close that it will be a matter of luck if things worked out this quickly.

You can't send in AOS as visa number for immediate relative is not available to LPR spouse for 5 years. If you send it in, they'll reject it and even may keep the fee of $1365.

Wait for your wife to become a citizen and has her certificate in hand - that's one of the questions on the form, is the petitioner a USC or an LPR - you have to provide the naturalization certificate number - then file everything - perhaps receipt notice gets you a refund of paid fees?

So here another point, couldn't we call a person USC right after she pass the interview in my AOS application? Is there any other way to get a naturalization number right after the interview?

No - you should be very careful about this... If your wife claims being a citizen when she is not, and USCIS finds out, they may reject her naturalization... it is a sensitive and clear subject. There is a section in the N-400 application that is dedicated to that... and it clearly asks if you have claimed being a citizen or claimed NOT being a resident during your LPR years....

A person is not a USC until the oath is taken. Make sure your wife doesn't claim being a USC before taking the oath. Asking the IO after the interview may not yield any results, but it is worth asking.

Once your wife passes the interview, she will get a form that recommends her for naturalization, and not confirming her naturalization - so not naturalization number is issued.

The best thing is to hope for a same day oath ceremony, but there is nothing an applicant can do to be granted same day oath - this is mainly luck of interviewing on the oath day.

I would look into what milimelo said, which is see if you can get a refund since your status changed... that would be the safest route for you if oath is not taken on the same day.
