ok so i'm filling out the 864 and on section 3 i'm not sure wha to put, do I fill say 9 and list my step kids since my wife is in section 2 and I also submitted a I-130 for them, or do I need to submit seperate 864 forms for them, also in section 5 it says persons NOT sponsored in this affidavit so myself and then... if i'm sponsoring my wife and kids I would not put them in there right? since I AM sponsoring them, oi -_-

why these forms are confusing...

maybe more questions later

I asked this question and someone said that just one I-864 was needed for all. So, if this is the case, you wouldn't list them on NOT SPONSORED in this affidavit, because it would mean to count them twice. Check what someone answered me.

Page 3, column 2, section titled "Do I need to submit an affidavit for each family member?"

specifically this part:

"Separate affidavits of support are required for intending immigrants for whom different Form I-130 family-based petitions were filed....

Often a spouse or minor children obtain visas or adjust status as dependents of a relative, based on the same visa petition. If you are sponsoring such dependents, you only need to provide a photocopy of the original Form I-864, as long as these dependents are immigrating at the same time as the principal immigrant or within six months of the time he or she immigrates to the United States. You do not need to providec opies of the supporting documents for each of the photocopied Forms I-864."

also, Page 5, part 3.

specifically:

"The immigrant you are sponsoring may be bringing a spouse and/or children to the United States. If the spouse and/or children will be traveling with the immigrant, or within six months of the immigrant's entry to the United States and you are sponsoring them, you should list the names and other requested information on the lines provided."

However, my doubt still remains since it says that for each separate visa petition (I-130) a separate I-864 must be filed. So, if anyone can clarify... thanks!

2010/01/28 I-130 + AOS + EAD Packages arrived at USCIS

2010/02/03 Checks Cashed

2010/02/08 Received NOA1 (Hardcopy) with Notice Date 2010/02/03

2010/02/16 Biometrics Appt. Letter arrived Notice Date 2010/02/10

2010/03/03 Biometrics Appt. (Early Walk-in 2010/02/22)

2010/03/05 Received Interview letter (Dated 2010/03/01)

2010/03/24 Received email stating that EAD card production has been ordered!

2010/04/06 Interview appt.- APPROVED!!!!!!!!!! :-)

For everyone interested: After reading the instructions and the form over and over, we decided to send 3 separate affidavits of support. Here's why: it says a sep affidavit must be filed for each immigrant for whom a sep I-130 was filed. And this is my case. One I-130 for me (spouse to USC) and one for each of my kids (stepchildren to USC). Also, the form specifically states that you should not list people for whom sep I-130 have been filed. (Part 3). So, obviously, three different affidavits must be filed.
