Need Help for AOS

Hi everybody

I am back.I have one question actually my friend came in USA on student visa 1.5 years ago. now he is in love with one girl and they are planning to marry.girl is USA citizen.

He has one question what happens if they live seperate after marriage? do they really need to live together after marriage for AOS?

another question is is it possible that he can stay in USA and file in India and wait for his visa in indian consulate? or if he do AOS but they really not able to live together for 3-4 months after marriage.

please any suggestions let me know. Bobby Umit,saspak,rahul if you guys know anything related thisplease reply me immediately because he is in hurry for this.

You have to prove the marriage is valid - living apart tends to make that difficult.

It's been done, but be sure to have plenty of evidence to back up the AOS.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi Richa,

I don't think its possible to file in India while physically here. Proving a legitimate relationship while living apart would be impossible and that too while on a F1 visa. Don't take that route.
