Do we need a joint sponsor?

Hiya,

I've just filed my I-130 and I've been looking at the forms that we are going to have to fill in.

In particular the affidavit of support.

My USC husband accepted a job in the states (Minnesota) recently. He starts his job on Jan 18th and his annual salary will $65000+

We have already signed a lease on a gorgeous condo and he is travelling there from Ireland on Jan 16th.

Im expecting my interview to be scheduled in a few months and I was wondering if my husbands new job would be enough for him to be my only sponsor (I'm afraid that he may not be working there long enough by that time, also he hasn't has any US income for the last 10 years as he has been living here ) or would we need someone else to act as joint sponsor?

Theres also a good chance that I may be offered a transfer from my company in Ireland which also has a few locations in Minnesota, in that way my income may be taken into account as well.

From what you posted, he will be able to meet the criteria for the I-864.

With that said, he will have to explain why he didn't file US taxes for the past 10 years (if he earned any income, he was required to) and he will need info from his new job (letter from employer, pay stubs, etc...)

If you want to include your income - read the instructions for the 864 - it tells you what criteria you will need to meet for that.

Yes, as long as he is currently (at the time of interview) earning enough to support you, then he can be your sole sponsor... be sure to bring a letter of employment from his employer and pay stubs... He will also have to write a letter stating why he has not filed taxes (aka.. he had no income etc...)

Hi, thanks for the replies.

Fortunately my (step)mother in law is a tax consultant so she has promised to sort out the tax stuff. My husband didnt realise he was required to file US tax returns while living abroad.

I wonder would you mind listing what Im going to need for the whle process?

I've sent away for my police certs, (Ireland and UK)

I'm starting to gather up stuff relating to our marriage like photos, documents etc.

Im going to get my husband to sign the I-864 before he leaves for the states so Il be able to fill in the details like his new phone number, tax return figures etc and submit them.

My name is on the US rental lease, will be added to all the ultility bills etc, my husband then plans to mail them back to me before my interview along with his pay stubs.

We are expecting our sons new US passport to arrive any day now.

Anything else Ive forgotten to prepare?

Sounds like you have everything you need. As soon as you get the info from the embassy as to medical, go and get it done, as the interval from getting that info to your interview may be shorter than you think/ than what they say on the letter (they told me I'd get a minimum of a month's notice, but it was less than a week when I got the interview notice; see my timeline below).

UPDATE: I had my interview today and YES they did want a co sponsor, despite supplying a letter of employment and 6 weeks worth of payslips. I'm absolutely gutted and shocked.

I posted this in your other thread, but thanks for coming back to let us know. I can't recall any consulate NOT accepting a new job, so perhaps this is a new protocol at Dublin. Sorry to hear this. I hope you get it sorted out quickly.

Hi thanks, I spent a good 15 minutes on the phone to the lady at the embassy earlier clarifying why we needed the co sponsor. I swear she hadn't a clue how DCF works. She kept saying that because Matt hadnt proof of US income in the last 2 years we needed the co sponsor.

But, to file DCF he doesnt need prior US income or am I mistaken? The USCIS extortion line was appalled that we were asked for this co sponsor when Matt is earning well over the poverty guidelines.

I kept telling her that we filed our 1040 and our 2555 foreign exclusion income along with Matts Irish P60 for 2009,2008 and 2007 because he was residing in Ireland for the last 5 years, and how was it that when our DCF petition stipulated at least 6 months residence prior to filing the petition was Matt supposed to have been working in the States?

She still insisted on a co sponsor so my fabulous father in law is very kindly rushing the paper work from the states to Dublin in order for me to get the visa/passport in time for our leaving date. Ive just sent the payslips and the proof of domicile off to them because they refused to even look at them yesterday at the interview.

I swear Im up to ninety!

UPDATE;

I'm going to update this for all Dublin DCF ers in the future.

I understand now what the lady in the embassy was trying to tell me.

They wanted proof of prior US income in the last couple of years regardless of present US income and because my husband hasnt worked in the US for 10 years they wanted a joint sponsor.

So my father in law sent off the paperwork but forgot to include copies of his and my mother in laws passport. I got the phonecall telling me to get him to fax the copies on Friday, they received them today and now my case is under review.

Does anyone know how long it might take now for them to issue the visa and get my passport back to me? Its really down to the wire now cos I want to travel on Sunday. Thankfully we havent bought the flights yet. Im so stressed out right now

I don't know anything about the delivery timing in Dublin -- hopefully penguin_ie will see this since she went through Dublin as well. Best of luck to you.

Thanks for that, I'm planning on ringing them tomorrow so Il post any updates. It will be worth it in the end, my husband will get to give our little one a cuddle, hes missing us both so much.

Things were different for me, because I got my passport back with the visa there and then. Nowadays, they post it out to you. So even if they sent it today or tomorrow, with the slowness of the Irish postal system, I wouldn't count on getting the passport and visa this week, sorry.

The only thing I could suggest is ring them tomorrow and ask - very nicely- if there is any chance of you collecting the passport later in the week in person due to travel arrangements.

True enough! I've been reading those nightmare stories about the CO in Montreal... *shudders*

Last night at an Oscars-viewing party, I met a woman who just took the foreign service exam; she wants to enter the consular section. She had to listen to me for 10 minutes rabbit on about consistency amongst COs. Poor lady.
