DID'NT GET MY SSN

I AM A K1 VISA HOLDER. MY VISA WILL EXPIRE ON JAN. 17, 2010. I APPLIED FOR MY SSN LAST TUES., JAN. 05. THE SOCIAL SECURITY OFFICE DENIED MY APPLICATION. WHAT SHOULD I DO? CAN I APPLY MY AOS W/O SSN? AND HOW ABOUT MY SON, HE IS A K2 VISA HOLDER. WHAT PAPERS DO I NEED TO FILE?

PLS. HELP..

No need for SSN for the AOS. You must have at least two weeks before the I-94 expires to apply for the SSN. Just reapply on a later time.

Your son will have a separate AOS process. Anyone may correct me if I am erroneous.

You are correct about the SSN but I don't know about K2's. You will need to apply for the SSN once you have your GC or EAD.

Remember that it is not your VISA date anymore, it's your I-94.

Here: http://www.uscis.gov/files/form/i-485instr.pdf page 5 says that AOS will be a separate process for you and your son. You can file at the same time, but you will need to fill in a separate form I-485 for your son. Other people should be able to assist you more who've been through this process.

Sorry, you went past the 'open window' for getting the SSN - it stops 14/15 days before the end of the 90 day span from the POE date on the I94.

NOW, you must wait until you have the GC or EAD, to apply again for a SSN.

As for the son, will need the GC for him, then apply for a SSN.

I echo the others here - you DO NOT need a SSN to file the AOS package.

Your visa was cancelled when you entered the US, it does not expire. Your I-94 expires. If you have at least 14 days left before your I-94 expires then you can receive an SSN in your MAIDEN name. Go to get it and do not leave until you talk to a trained employee that knows K-1s get SSNs. If you have less than 14 days until your I-94 expires wait until after your green card or EAD is received. Yes, you can file for the AOS without the SSN

here is how it works for less headaches...

1. Arrive in USA

2. Aopply for SSN

3. Unpack your suitcase

4. ghet married

5, apply for AOS

6. Change name on SS card if desired (number never changes, name doesn't really matter much)

Apply for you SSn the day after you arrive in your maiden name exactly as in your passport

You are correct about the SSN but I don't know about K2's. You will need to apply for the SSN once you have your GC or EAD.

Remember that it is not your VISA date anymore, it's your I-94.

Here: http://www.uscis.gov/files/form/i-485instr.pdf page 5 says that AOS will be a separate process for you and your son. You can file at the same time, but you will need to fill in a separate form I-485 for your son. Other people should be able to assist you more who've been through this process.

K-2s, children of K-1s must wait until they have a green card for an SSN. The ONLY K visa eligible for an SSN is the K-1. This is because until 2008 SOME jurisdictions required an SSN for a marraige license, K-2s do not need marraige licenses, neither do K-3s or K-4s, so they do not get SSNs. SSNs are no longer required for marriage licenses (Supreme court ruling in 2008) but the SS administration hasn't caught up yet and still issues the cards to K-1s. The SSN comes in handy for all sorts of things, so get one ASAP, but it is not needed for the AOS

Sorry but you waited to long to apply for a SSN. As VJ guides advise, apply for a SSN around 2 weeks AFTER arrival (POE). ID cards, bank accounts, tax filings etc go so much easier if you get your SSN card early.

You do not need a SSN for AOS. You will re-apply for a SSN after your AOS is approved and GC is processed.

There are three dates here, ya?

1. visa expiration date - doesn't matter, once you come into the USA.

2. POE entry date

3. I-94 expiration date.

IF YOU ARE within 4 to 74 days of the POE entry date, then go apply again.

If you are between 15 to 1 day of the I-94 expiration date, you've lost the window.

Check yer dates, let us know the I-94 expiration date?

K-2s, children of K-1s must wait until they have a green card for an SSN.

Wrong

The EAD fee is included in the AOS filing fee so nothing stopping you from getting the child an EAD card Look at the I-765 instructions. Says , nothing there about a minimum age for K-2 file under A6 or C9 category .

The ONLY K visa eligible for an SSN is the K-1. This is because until 2008 SOME jurisdictions required an SSN for a marraige license, K-2s do not need marraige licenses, neither do K-3s or K-4s, so they do not get SSNs. SSNs are no longer required for marriage licenses (Supreme court ruling in 2008) but the SS administration hasn't caught up yet and still issues the cards to K-1s.

Wrong again.

INS at the time was having trouble getting EAD cards out to K-1s that filed under the A6 category before the K-1 status expired, so SSA changed the requirement of K-1s needing an EAD stamp or card to be assigned an SSN. Had nothing to do with getting married.

Hey men

you shoul apply SS# ,before 20days with I-94 expried ,any way you must to apply AOS or EAD asap and then you reapply SS

We do have same the problem ,we wents to SS# Dept apply and they told us that ,we must apply before 15days with my I-94 exprired

Not trying to hijack the OP's thread, however I thought you could indicate on the DS-230 part two that you want a SSN issued along with a card. Questions 43a to 44. Can you not obtain a number and a card this route?
