If the teens have sex amongst themselves, that's one thing and yes they will and do, but if an older adult preys on a teen (the adult was dishonest and used his position of authority and experience to persuade a pre teen in this case to do something that in all honesty she would not have done without the enticement - or are you seriously suggesting that this was an equitable sexual contract?), then no, they don't have the wherewithal to make that decision and if society puts the onus on the adult to not behave in this way (hence the sentence for the adult, not the child) then yes, that's a sensible way to deal with this matter.

So, a 21 year old having sex with his 17 1/2 year old girlfriend is rape.

But a 18 year old having sex with his 14 1/2 year old girlfriend are just two teenagers getting it on.

Interesting then that after 3 years of this tender, mutual, consensual, and long-lasting relationship the 18 and 14.5 year olds are suddenly thrust into the legal spotlight as 21 and 17.5 year old rapist and victim.

I think it's clear to all but the most dogmatic that statutory rape laws can be weird and senseless.

I think it's more a matter of where does the law do the age cut off? They can't just do it as one poster suggested, on the supposed maturity of the child, so they picked the legal age of consent (which can differ from state to state). I think most people would agree, that a 12 yr old would have less ability to make the right decision (in this case) than a 17.5 yr old.

Should the parents be charged for child abuse also? Here in ny state under a new law if you drive while drinking your children can be taken away from you if they are in the car with you( over.08) Should the parent be held accountable for allowing the child to be near this person unsupervised.(a 12 year old)
