Ty everyone and mr charles. I am really looking to see what our next step in this journey will be. Nigeriaorbust ty. Can anyone tell me if i go there and marry him what would we file then and would we have to cancel the k1? Pls help i have contacted my senator and my congressman, im not sure what all i can do now since they r both telling me they r waiting for a response from the embassy. Im not crying but im really frustrated lol and need to go to the hairdresser because im looking real raggedy. Be blessed

Part of your next step is USCIS center dependent. If you filed for a k1 through CSC your petition is as good as dead. CSC will jerk you around for almost a year and then send you a letter the the petition has expired ( and you are free to file another one ) They do not make a decision on what the consulate says which is good because you don't get the fraud tag Marc Ellis warns about. Youcan either go another K1 ( and file right away ) or go get married and file the CR1 when you get back ( forget the K3 it isn't any good ) DO NOT cancel the k1 as that makes it seem to their stupid computers that you are admitting that Lagos was right.

If you filed through VSC they will look at the returned petition and either reaffirm it ( and you save the money of a refile ) or issue a NOID and you can submit more evidence or let it expire .

This will not be over quickly. You will not enjoy this.

Ok ty, we filed through VSC. Yes our next step was to get married. So right now i guess we wait til it gets back to the states before we make any move.

How long are in Nigeria for and are you a legal resident ? If the USC legally resides in Nigeria for 6 months a direct filing ( DFC) is allowed. No matter what make sure you get lots of pictures and make yourself well known to the neighbors. If they do a home visit ( which is likely after a denial ) they may ask neighbors if they know of you.

This will not be over quickly. You will not enjoy this.

Im not in nigeria, i only went there for a week in feb. of last year. When i was there i met his neighbors. Is the home visit after they send the application back to the states?

Nigeriaorbust what should we do if it hasnt been returned yet and my senator and congressmen is saying they r waiting on a response from the embassy?

I would expect a home visit as part of the next pass though the embassy. Because you have one returned visa they will look more closely at the second one. When are you two getting married ?

What response do you get when you contact Lagos ? If you had a well prepared case there is a decent chance that VSC will review it and reaffirm it. If the case was so so then the result is less clear. It may pay to talk to someone that knows immigration inside and out. I like Marc Ellis. My gut would be a second well prepared k1 and be in Nigeria for the interview. You probably should make another trip before the interview also. That would be more trips to show your relationship. You are dealing with a large reverse age difference and immigration is rooted in the ideals of the 40's as far as that goes. Because you have a number of red flags they will try a bit harder to research the relationship. Starting last summer the number of home visits and incidents of AP have gone up. If you have a really good elected representative they may get Lagos to take a second luck. Mine was worthless in that regard.

This will not be over quickly. You will not enjoy this.

if you do decide to get married and refile then use that opportunity to front-load your application by submitting tons of evidence and especillay letter from relatives, I hear it helps. We have a saying where I come from that when an elder holds up what belongs to a child, they will put their hands down once it starts aching them; what's yours will surely come to you.

just wanted to wish you well, I know what it is like to be denied and go through the long process. I have been in VJ for quite a while and i stop by every now and then. I have seen people who fought for a while and eventually prevailed even when it seemed almost impossible. Stay strong. Personally It was difficult using the senators but I do believe that you should try the CR-1 route. you will run into similar issues as it will be documented in your file but really really over prepare with your evidence and plan on being there at the interview so that they can see the dedication that you have for each other. Just wanted to add to the positive outcomes. We are doing really well in our marriage/relationship and have a beautiful son.

I am so sorry you have to go through this, but the good thing is that you are on a very good site. I remember my friend had to go through something similar like yours, it took a while for them to approve his visa, maybe 6 months after they denied his first interview, but she did not give up, so we are here to support you everyway we can. Just keep in mind that your husband will be with you soon.

I am so sorry you have to go through this, but the good thing is that you are on a very good site. I remember my friend had to go through something similar like yours, it took a while for them to approve his visa, maybe 6 months after they denied his first interview, but she did not give up, so we are here to support you everyway we can.
