Hi, im a us citizen, born in us but lived in uk most of my life. My husband is from the uk. We have 3 kids whom were all born in the uk. I would like to know how to get them a us passport. I do not meet the requirements set out by uscis, for the kids to get them in the uk. Can I travel to the us with my kids, using a holiday visa and apply for passports in the us?? i have been told that their uk passports must be stamped with an I-551. Can someone tell me if this just means legal entry into the us or do I need to file some sort of paperwork for the I-551 stamp to be issued. any help would be gratefully appreciated!

I'm not sure how many people here would know the answers to your questions. If you and your kids have valid passports, US or UK, I'd think traveling under VWP would be permitted. You may want to call the US Dept. of State and make an inquiry.

Afaik, you cannot get US passports for them as they are not currently US citizens (don't qualify for CRBA). Your only option would be if they moved to the USA (not on a holiday visa, but to reside), then they could apply.

This page describes ways for children of a US born parent to get citizenship for children born abroad. http://london.usembassy.gov/cons_new/acs/p...ts/robirth.html

A child born outside of the United States to one U.S. citizen parent and one non-U.S. citizen parent may be entitled to citizenship providing the U.S. citizen parent had been physically present in the United States or one of its outlying possessions for five years, at least two years of which were after s/he reached the age of fourteen. This period of physical presence must have taken place prior to the birth of the child.

I guess you weren't in the US long enough to meet the presence test is why you say you're not eligible. Do your parents live in the US? The same page has this question "What if I do not meet the requirements for transmission of citizenship to my child?" with a link to tell how a grandparent can qualify him for expeditious naturalization. The rules will be basically the same I would think whether you're in the UK or visiting the US. I'm sure you can't just apply for a passport at the local post office without a birth certificate showing birth in the US. It would have to go through USCIS to determine if the children qualify since they have no US birth certificate.

if you do not meet the physical presence test but your parents do you may be able to apply for expeditious naturalization:

I have a friend who was born in the US but spent most of her life in the UK/Germany. Her children (both born in Germany with a German father). She was able to get citizenship for them this way.
