Timeline

Hi guys - are any of you in the states already?

My husband and I got married last year and I submitted my I-130 earlier this month. I just got a notice of receipt. I'm getting nervous though because it sounds like I should have filed the I-485 at the same time? I thought the step was to file the I-130 first and then file the I-485 once that went through. I'm a USC but my husband is F-1. I just don't want to have to deal with him having to leave the US as I'm pregnant and it would be a huge stress on our family. Any words of wisdom would be helpful. Thanks!

Since you s.o. is already in the States on a F1 you are in a totally different position than normal CR-I filer.

All y'all need is Adjustment of Status. Sorry, since I am doing the CR-I from the beginning, I don't know anything about adjusting the status. Maybe you can use the search and can get some useful information.

It's been over three weeks without a touch (Jan 8th) and while that's probably pretty normal given the backlog, I was really hoping that the case would have been touched so that at least something is happening. Anyone having any luck with CSC and touches?

You ask me why I said that? Because that's how it is if you don't do DCF. Right now, the Septemberfilers get their NOA 2s, only one October filer who expedited his petition got his NOA2.

As far as I know the whole process takes longer than just five months since those are meant to be just for the first part of our journey. I am prepared for 9-12 months till everything is over.

USCIS is showing a 5 month processing timeframe. That's conservative overall. There have been many on here that have had NOA2 approval in two months and under. Many others have been far longer. I think those that got NOA2 in two months or so may not necessarily be the normal or average but have had it only take that long. Again the website for approval for NOA2 is around that five month mark. So it seems that filers from Sept/Oct 2009 are now getting NOA2s completed. I'm not sure if the situation in Haiti is likely to delay some of our petitions, probably it is quite likely.

The RFE means a request for further evidence - that means if a form was incorrectly filled out or missing a signature or if they require any additional information for any reason, USCIS would send you a request ie RFE. Not everyone gets this request, only if USCIS requires this. Some get approved without an RFE.

My application is dated for Dec 3rd and i havent got a touch at all. I am truely crossing my fingers to see something by the end of the month, If the total process is suppose to take only up to a year then this first step takes up a big part of it.

I haven't had any luck with ours either. It was almost the same day as yours. Looks like we will be waiting few months before we get any touches. Waiting is all that we can do for time being.

Check was cashed yesterday! There's a WAC reciept# on the back of the check. When I try to look up the case status using that it says case not found. Should I be worried?

The number on the back of my check was one off from the number on my NOA1 receipt.
