Very Confused Needing Advice

Hello all, this is my first post and I am trying to sort all of this out. I am very confused and would appreciate advice. My boyfriend is from New Zealand. We are talking about getting married and are trying to figure out the best way to go about this. After some recent health issues my Dr. told me that if we plan on having children we should do it soon. That has prompted us to get serious about marriage. Ideally we wanted to get married in New Zealand in a small ceremony including his parents and then come back to the states for a ceremony with my friends and family. When talking to the immigration officer she told me that it would be better for us to get married in the US because the fiance visa and getting married process would probably be shorter than the spousal visa (K-3 ?) Can anyone give me advice on this situation. It is very important to him to get married in New Zealand, but he also understands that doing so could mean more time apart. We don't want to miss our window of opportunity for having kids.

Take a look at that link, it outlines the pros and cons for the different visas

The K-1 in your situation would be quicker as you can petition for it today, unlike the spousal visas which would require you to be married

Disregard the K-3. It is expensive, slow and obselete in most cases.

If you want to do a spousal visa, go for the Cr-1.

Good luck.

1. Never call the USCIS misinformation line. They know nothing about visas. (Yes, really, I mean that.)

2. K3 is virtually obsolete.

3. K1 is generally a faster way to be together if you've already met, since you can start the process now instead of waiting until after you're married.

4. The big downfall of the K1 fiance visa is that the foreigner is stuck twiddling their thumbs waiting months for work authorization.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

For those who got married outside of the US what has your wait time been for visa approval? I said in my first post that it is important to him to get married in New Zealand, but it has also become important to me. We will be living in the US so it is only fair that his family get to participate in the wedding. His parents can not travel to the US so that is out of the question. Just wondering what the wait times for others have been, and were you allowed visits in the meantime? The immigration officer said that visits may or may not be allowed.

Thanks so much to those of you who have responded :)

Married in Canada. Visa processing time - 9+ months

Admittance and duration of stay is up to the agent at the time of the visit. No one can guarentee that he will be allowed to visit. Increasing, and showing, ties to his home country are important

Good luck
