NO EAD!!! AOS INTERVIEW IS IN 5 DAYS!!!

Let me give you guys a little background info. about our case BEFORE I ask questions...

AOS, EAD, & AP filed: October 16, 2009



NOA1 for AOS, EAD, & AP: October 23, 2009

Biometrics: November 17, 2009

AP recieved: December 22, 2009

AOS Interview: January 12, 2010

EAD received: ?????

Okay...... so our AOS interview will be this coming Tuesday, January 12, 2010. My husband had his biometrics done in mid-November 2009. We received his AP in December followed by our interview letter. We still have not received his EAD card though. I'm very worried about that. Is that normal? We have our interview in just 5 days!!! Also, I was wondering.... if my husband ends up receiving his Greencard BEFORE his EAD, can he start working using his Greencard or no????? :blink::wacko::blink: I'm so confused... somebody PLEASE HELP!!!!! I'm so nervous & worried!!!! :o :o :o

US Entry-----------> July 27, 2009

Marriage-----------> July 30, 2009

AOS Filed-----------> October 16, 2009

Biometrics-----------> November 17, 2009

AP received-----------> December 12, 2009

AOS approved-----------> January 12, 2010

Greencard received-----------> January 23, 2010

I-751 Package sent-----------> November 28, 2011

Package received-----------> November 29, 2011

NOA-----------> November 29, 2011

Check cashed-----------> December 1, 2011

If your husband recieve his greencard then the EAD is no longer needed. EAD is just a temporary permission to work until you get your green card. Since you didnt schedule a infopass to find out why you havent recieve the EAD, I wouldnt worry about it now seeing that your interview is next week.

Came to the U.S on a F1 visa January 2008

Got engaged to my USC girlfriend Dec 2008

DEC 29th 2009 Married

JAN 27th 2010 Medical completed Jan 27th

FEB 17th 2010 AOS + I-130 package sent

FEB 25th Got emails with all receipt # ( but not able to check on USCIS site)

FEB 28th Online status check available

MAR 1st Received Hard Copy of NOA's in the mail

MAR 8th Received Biometrics appointment in mail: for Mar 18th (however no updates on site or email notifications)

MAR 9th Biometrics complete via walk-in (All docs touched on USCIS site)

MAR 26th Received interview appointment (For May 6th)

APR 23rd Touched on I-130 and I-485

APR 26th Touched on all docs, EAD card production ordered

MAY 1st Advance patrol in mail

MAY 6th Interview (Request for additional information)

MAY 6th EAD in mail

June 1st (RFE mailed in)

June 28th Notice of approval on USCIS website

July 3th GREEN CARD INT HE MAIL!!!

Doesn't happen that often, but it does and is possible to get not only the AOS interview but the PR/Green Card itself before getting the EAD. Can work once either is in hand - once the PR/Green Card is in hand, the EAD is no longer needed (whether you have it or not). Good luck on the interview. :thumbs:

My wife got her green card before she got her EAD. The Green card trumps the EAD anyway. Yes, he can work with a green card. No worries.
