Need a little help

Hi to all and a happy late holiday, my fiance was granted her K-1 visa and arrived in the US about a week ago, im planning on going down to the court house later this week to get married, then after getting the marriege lic applying for her SS card (this is what the officer in customs told me i had to do)..

my question is the following

1- Does the I-485 (baring she gets her residency) give her permision to work and travel, or do i need to also fill out both additional forms.

2- When filling out any of the form under her last name will i be putting in my last name, or her maden name (if it does not specify)

3- On the list of things i need that i got from this web site it for #6 is says " Copy of the non US valid I-94 (front and back)-------What is that???

i have more question put if somone could answer those three i will greatly appreiciate it

My first advice would be to read (or re read) the guides pertaining to Adjustment of Status for K-1 and the guide on how to obtain a SSN

I didn't wait for my marriage licence to ask for a SSN, so now I have a SSN under my maiden name, I'll change it when I'll receive my EAD and such.

* The I-485 is for adjustment of status only, you need to apply for the EAD (work authorization) and AP (permission to travel) at the same time and file all the forms together to avoid more fees.

* If your fiancée wants to change her name to yours, all forms must be completed using her married name, the maiden name is usually asked also.

* The I-94 is the white card that is attached to her passport, usually next to her visa. She had to fill in the form in the plane and the Immigration Officer at the airport should have stapled the bottom part to the passport and maybe put her A# on it.

thats what i remember reading but the both officers told me i had to get married first then get her social security card, since im getting married this week will that make a difference??? that way i skip a step of having to go back and change her name

ok so in addition to the I-485 i will need to fill out the I-131 and I-765 as well correct? the $1000 that i will be paying includes all three i imagine.

Fee is $1010.00 for AOS from the K-1. (Only covers the 485 and biometric fee)

The AP/EAD is free if requested at the same time or after the AOS is filed.

If your lucky, you will get the GC before the EAD/AP show up. (or within days of each other).

The I-485 eventually leads to being granted Permanent Residency status - the Green Card - this does give the immigrant permission to work and re-enter the US when traveling.

2- When filling out any of the form under her last name will i be putting in my last name, or her maden name (if it does not specify)

Use which ever name she wants to be known as - if that is her married name, then use it on the AOS (and related) forms.

3- On the list of things i need that i got from this web site it for #6 is says " Copy of the non US valid I-94 (front and back)-------What is that???

This will be attached in her passport - it is what gives her legal presence in the US - it will show an expiration date of 90 days from the day she entered the US.

Best advice is to follow the Steps in the K-1 Visa Flowchart (found in the Guides section) and get all the details of forms etc in the K-1/K-3 Adjustment of Status Guide.

Most folks will complete all the AOS-related forms (the I-485 of course, the I-765/Employment Authorization and even the AP/Advance Parole/I-131).

Firstly I think you should read the this post: http://www.visajourney.com/forums/index.php?showtopic=235331 (which i wrote so I know it's self-serving) which should help explain things a bit better, and also gives you links to the guides and forms etc.

To answer your qns directly (which the post i mentioned above hopefully does anyway)

1. The 485 simply adjusts her status (referred to as AOS) from K1, to conditional LPR (legal permanent resident). It can take some time to receive the green card (that is the result of this paperwork) so it is advised that you apply for EAD (employment authorisation) and AP (advanced parole) at the same time as these are free when applied for at the same time as AOS

2. First, when you fiancee fills in the marriage licence things, normally she would write her maiden name, and then the name she wants after marriage BUT this apparently hasn't been the case in all states. Double check when you fill in the paperwork (i.e. ask) where you make sure her name will be "X" after marriage (there is one girl who thought she changed her name but didn't write that on the paperwork so she needs to pay for a legal name change). After that, your wife is now LEGALLY known as her married name. In order to get her green card, EAD, and AP in her married name, she will need to fill in her married name in all the boxes, and her maiden name where it says "former name". The photocopies of passport are of course going to be in her maiden name, and this is another reason why the marriage certificate is enclosed showing that she's legally changed her name.

3. The I-94 is the little piece of paper (card) that she had to fill in while on the plane travelling to the states, and that was eventually stapled into her passport by the person that took her visa paperwork (the brown envelope). In my case he put it on the same section of my passport as the visa just 'cause he had that page open.

I would point out that if you're not in a hurry to work or travel, you don't HAVE to apply for EAD or AP. You can do both when you get the green card.

There is no additional charge if you include those two with the AOS paperwork, so most people do.
