Timeline

Just wanted to inform VJ users that Social Security will not issue a Social Security number if you wait till within 14 days of expiration of the visa, even if you are already married. I found this out the hard way and they said that we need to update the I-94. The only way to do this is to wait for the EAD (work permit) to come in and that will be around another 90 days. I cannot file a joint income tax return until we get my wife a SS#. I will have to wait for my refund. While it is true that you should wait about 3 weeks for the entry record to be filed, make sure you apply for the SS# with more than 2 weeks left on the visa.

couldn't she get an ITIN then get the SSN later? This way you can file "joint".

I was got the problem because long mild name isssue

please you guy look at I-94 and compare with passport

Yes, I was told that by USCIS. It just means that I have to wait 3 more months for my refund, not a really big deal. I just wanted to let others know this so they won't get caught up.

Procrastination is never a good idea, Most people know this.

I actually forgot over Christmas holidays. I was too much in bliss with my new wife. I am usually not the procrastinator.

This is one reason the K-1 Flowchart shows SS# as Step 16 (step 15 being 'enter the US').

True dat, but the problem is that you have to wait at least 3 weeks an then it was 1 week from my wedding and I decided to wait until after to file with the married name and then I was in the finals for my Master's degree and then it was Christmas holidays. No excuse but I lost track of the time. Just letting others know not to fall into the same trap. It's not the end of the world but does cause some personal delays. As long as our AOS is on time, we'll be okay.

I looked at that and it still takes 4 to 6 weeks. I'm not sure if it will negatively affect her SS application afterwards. I'm not sure I'm willing to take that chance just to get my refund 2 months earlier. We are still on track for the AOS anyway.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'd go the EAD then SSN route. The first year Rin was here we did the ITIN. You have to send your return along with the W-7 to one location. They process the ITIN (Rin's took about 8 weeks) then forward that along with your return to another location to process your taxes. We filed in June 2007, received refund in October 2007.

Actually, it is 14 days before your immigration status expires at the time your immigration status has verified and they are going to clear the application. It is possible for a K-1 to have applied the first day they arrived and entered the 14 day period waiting for immigration status to verify.

Best to give yourself at least a month before your status expires to allow for any delay caused by the verification of your immigration status.

you can apply for the ITIN at the time of submitting the tax return. attach the W-7 to the tax return. it shouldn't impact the SS application

either the ITIN route or waiting for the SS should work for you.

Note: If you wait till April and go the ITIN route, it may take longer to get your refund (if you get one)

(Q) What steps do I have to take when I have an ITIN and become eligible for a Social Security Number?

(A) Make proper application for a SSN and upon receipt advise the IRS ITIN Unit in writing of your new SSN. The new SSN will become the primary number and must be used for all future filing purposes. The IRS will void the ITIN. All prior tax information under the ITIN will be associated with the new SSN.
