Hi,

I am a little ashaned to be asking for help on this, however I am really starting to stress out over it. Any advice would be most appreciated.

My now Husband and I have just recently been married. He lives in the US and I in Canada. Prior to getting married, we have been in a long term relationship for 5 years. He lived in Canada for some time and recently moved back to the US. We had plans to get married and recently decided to do a brief ceremony here in Canada. With a few phone calls we had someone available to do the ceremony for us. We did obtain our Marraige Liscence as well as the Marraige Certificates. My issue is that with all of the excitment we did not think nor obtain his previous divorce decree and proceeded to be married.

Now since I have pulled the I-130 forms so we could get the paper work started for the CR1 Visa, it states this inf. must be provided. What should I do? Should I leave it as is and hope they do not do a Public Records to see if either of us has been married before? Or is there something I can do to correct this mistake we made?

I am not sure I understand you. My husband and I got married without a divorce decree but we were both legally divorced and able to legally get married. If you were both divorced then you have done nothing wrong in getting married. You must however have a proof of your divorce if you were previously married when filing your paper work for immigration. Never lie. Order the divorce decree and when it arrives send in your paperwork.

Yes, you need to submit the divorce decree to USCIS, your marriage is valid - obviously - since you dont' need to produce a divorce decree to get married. You do need the divorce decree to immigrate to the US.

Not submitting it would be a denial and then you have gained nothing

correct this mistake we made?

what mistake? all you need is to have divorce decree from the court, when filing the I-130.

If you've not filed the I-130 yet, then yer OK. go get the document. MUST HAVE a court stamp on it. Suggest getting multiple sets, since HE will probably get to a courthouse to do this.

As long as he was divorced, just have him go to the courthouse and get copies...and yes SEND THE STAMPED copy!! I learned the hard way! Also, if your husband moved from where he got divorced, he can have anyone go in to that courthouse and get copies of it as it is public record.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
