Hey all!

First of all, I wanna greet everybody a Merry Christmas and a Happy New Year!

I hope everybody who is with their loved ones had a great time during the holidays!

And to those who are not, just hang in there and you will be with your beloved soon.

Anyways, now that it's January, everybody is preparing the forms needed for their taxes.

I'm wondering if it's possible that hubby can claim me in his taxes?

I'm currently unemployed with a 2-year Conditional GC.

If yes, is there any papers that we need to present with the filing of taxes?

As far as I know, if you guys are married by December 31, 2009. You can file your taxes jointly.

I got married last October and Im filing a joint tax return with my wife who doesnt even have a green card yet.

Yes, you can file married filing jointly, you need to have a SSN/ITTN...

Yes you can, I got back an extra $6000.00 on my return when I added my wife

Of course you can always file a 1040X to ammend the taxes if you file married filing seperate because of no SSN... Once they get the SSN# you just ammend the taxes... Of course it is easier to do it on the front end...

He will file "Married Filing Jointly", but need to also send in IRS form W-7 to get your ITIN. This must be submitted along with the Federal Tax Return. Once you get your ITIN, you can file your state tax return.

It reduced our amount of tax owed by nearly $10,000 (vs. filing Single).

He sure can! You will need a Social Security Number.

He will not be able to deduct any of the costs involved in the visa though...

Sure! :thumbs: Ours back in 2006, we had to file for an amendment I remembered coz I don't have SSN yet when DH filed his taxes.

Same issue with us last year..

The Law states that you can file jointly or separately...

We did file Jointly.. He included me as his depended, but i also disclosed my income from the philippines, but was later excluded because it was below the limit of taxable income.. but all in all we got 7k for our state and fed taxes yay! =)
