Hi - my husband and I went in for our interview on Dec 23, 2009 and we were placed on Admin Review for six weeks. At that time the embassy will either tell him that he has the visa or he doesn't have the visa. If he doesn't get the visa, what are our next steps? I'm not sure what else to do. I contacted a lawyer and she did say that there is nothing I can do now until after the embassy makes there decision. But I want to know if anyone of you ever had to go through something like this and what were the steps you took after the admin review?

Well, if the visa is denied it will be sent back to the USCIS at which point you will have a chance to send in additional information or documents to help overcome the deniel. Many times with K1 the petition will have expired before it can be re-affirmed so some people will work to overcome the reason for the deniel and file again for K1 while others have gotten married and filed for Cr1

since you are married, if the embassy returns your file to uscis, you will have an opportunity to rebutt the consular's findings. uscis will send out notice to revoke/deny to which you will be given a small amount of time to respond. usually 30 days, but i have seen as little as 15 days. so in the event that your husband does not get his visa, i would strongly suggest you start gathering evidence to back up your file.

i do hope that he does get the visa, because if it is returned to america, then there is no specific timeline they will get to your file. good luck :thumbs:

Thanks everyone. I'm kinda thinking that it might be easier to prove to the USCIS that we're truly a couple because they won't ask me why I am sleeping with the man and we didn't get married in Hindu rights. Or if my parents don't have an issue - even his parents - have an issue with the fact that we're sleeping together and we didn't get married in hindu rights. WE'RE MARRIED FOR CRYING OUT LOUD! I changed my name all over the place. He's on my lease and my insurance. I don't know. We still have to wait and see.

So what kind of fuckin bullshit is it when someone STARTS talking to someone in the phillipines on Jan 2 of 09 and on Jan 10 of 2010 she is getting a visa to come to the states? I've been with my husband for the 2.5 years and we've spent close to 20,000 US dollars on travel and phone calls and yet we can't fuckin get our visa!!!!!!!!!! This just makes me sooo fuckin upset!!!!!!! My husband is not a terrorist, he doesn't have TB, he doesn't sell drugs, and we have never frauded or attempted to fraud the friggen government! So why the #### can't he fuckin get his visa????

simply put, taking the interview and documents out of the equation. it depends on the country that the beneficiary is coming from. some people have easy consulates, and some consulates just plain suck.

Sorry about the laungage - I was really upset earlier. The phillipines is mentioned because I've been on VJ for amost 3 years and statistically most everyone that goes to that consulate gets a visa. Pay attention and I'm not the only one that has noticed that.

And yes Twisted K, you're right - I know. I'm just soooo frustrated right now with the entire process and the system. Nothing makes any sense anymore.

sorry to hear that. did they give you a specific reason? have your husband scan in the sheet they gave him. contact your senators' offices. see if you can get a second interview, etc. if it does make it back to USCIS, then you will have the opportunity to rebutt the consulars findings since you are married. an opportunity not afforded to engaged couples.

Well our visa was refused.

I'm sorry to hear of this denial. It scares me to think that even with the length of your marriage they can deny you too. I hope this doesn't happen to me.

02-25-2010 : Received NVC case number, but NVC is closed, so I can't give an operator our emails. :-(

02-27-2010 : Jumped the gun and emailed the VJ version of the DS 3032. Who knows what will happen :-)

03-01-2010 : Gave the operator both emails...waiting on DS3032 kit

03-02-2010 : Received DS3032 Kit; Resent DS3032 (just in case), Received AOS bill.

03-03-2010 : Paid AOS and IV bills; both are IN PROCESS

03-03-2010 : VJ email version of the DS3032 accepted (It was the one that was sent on 02-27-2010)

03-11-2010 : Both AOS + IV showed paid but processed on 03-05-2010 :-)

Well me and my husband was on the same situation with the embassy. WE went through the same procedure. What we did was to take a lawyer now and let the lawyer get in contact with the embassy. In my case, they asked for a second interview and we went in in December I think it was December 12, 2008. My husband was so frustrated he took a lawyer who wrote a letter stating the evidence of relationship that we have and ask what other evidence was required? She wrote that letter in February 2009 and in March 2009 I got my visa. my thoughts to you is to work at the embassy before the papers are sent back.
