Hello Everyone,

I have a few questions about filling for the AOS. My wife came here on a K-1 Visa and after we got married I am sort of confused on how to do the the AOS paper work.

My first question is is that I know we need to file for a Social Security Card but I am not to sure on how we can change her family name to mine and if we do change it, do we use my last name on all the AOS paper work or do we use her orginal family name?

I am a little confused on how to take the next step from here. If anyone could help I would much appericate it.

For one no need SS Number to apply for AOS. She can apply to SSA in her maiden name and change it later if she wants a SS card. GOOD idea to get one. If less than 2 weeks before the I-94 90 day expiration SSA normally won't issue one until after she gets her GC.

As a K1 visa person your wife is entitled to a SSN. There is a guide on VJ about getting it. She will get it in her maiden name and really all it helps right now is to open a bank account (in my experience). Whether she gets one now or waits is up to you. I got one in my maiden name and am now married. Aside from the bank account, if you wife doesn't need it, it might save time waiting (time waiting in the SS office, going to get the maiden name one, then again married name one).

On the marriage application it said "current name" , "name after marriage". Some people have had issues where their marriage licence DIDN'T say that so just confirm with the person at the court "this is what I want my name to be, how do I make sure of that?".

For AOS, I file everything under my married name and on all forms (except the AP) it has a space for "former name" which is where I've written my maiden name. Also I include my marriage licence (it's required) and that's my proof of change of name.

Once the AOS process is complete everything will be issued in my married name (EAD, AP and eventually GC) and then I will arrange to have the name on my passport changed (which is a HUGE pain 'cause I need to change my name in Australia, they don't register my marriage licence unless it's Australian).
