Fiancee's mother had her visitor visa revoked at LAX

I was talking to my fiancee this evening as I always do and I was telling her about the approvals coming from CSC. I have a fairly recent NOA1 so I wasn't really planning on anything happening for awhile because of all the March and April people I would hope are ahead of me. I was touched today, but it was the same message I received back when the acknowledged my IMBRA RFE.

Anyways........

We were talking and she asked me if I thought that our application may come under greater scrutiny because her mother's visa was revoked upon arrival at LAX since she listed her parent's names on her G-325A forms. I'm not 100% sure of the reasons it was revoked but I know a few things. This occurred a week or so after 9/11 and she was flying from Malaysia (a mostly Muslim country) to Los Angeles. She was questioned by Immigration and being the person that she is, probably got a bit indignant at the questioning. She thinks of herself as a very refined Chinese lady and she speaks "proper" English, etc. They kept her for two days in an office with less than nice accomodations, revoked her visa and sent her home. I'm sure she was not treated well, but I can sympathize with the Immigration officials after what had just happened in New York.

So....

My question is....any thoughts on whether her actions will have an effect on our application? If so, where in the process would the delay occur? If I get the NOA2, are we clear?

09 May 2006 - Delivered to Laguna Niguel (USPS tracking) and is also the Received Date on the NOA1

24 May 2006 - Check cleared the bank

25 May 2006 - Received NOA1 in the mail (postmarked 24 May and notice date of 22 May)

28 June 2006 - Received IMBRA RFE in the mail (postmarked 27 June and notice date of 23 June)

29 June 2005 - Returned IMBRA RFE overnight service to CSC (signed as received at 7:46 AM, 30 June)

03 July 2006 - Received 2 identical emails from USCIS-CSSO saying they sent me the IMBRA RFE

04 July 2006 - Touched

05 July 2006 - Touched

05 July 2006 - Received 2 identical emails from USCIS-CSSO stating they received my RFE response on 5 July

06 July 2006 - Touched

25 July 2006 - Touched

25 July 2006 - Approved

31 July 2006 - NVC received my application

2 August 2006 - NVC sent my application to embassy at Kuala Lumpur via DHL

7 August 2006 - Received letter sent from NVC dated 3 August stating they received an approved I-129F

23 August 2006 - Packet 3 received

forgot the dates for interview, approvals and such...but we delayed for awhile so kids could finish school

29 December 2007 - K-1 and kids (K-2) arrived at LAX (oh..me too)

12 March 2008 - Got married

28 March 2008 - Filed AOS, AP and EAD

13 April 2008 - Received by USCIS

17 April 2008 - Notice date

21 June 2008 - Received AP approval letter

28 June 2008 - Received EAD cards

24 September 2008 - Received interview letter

Interview scheduled for November 25th

25 November 2008 - Interview in San Bernadino, GC approved

11 December 2008 GC received

Alot depends on why it was revoked. More than likely it was because of the hysteria taking place after 9/11 and should have no affect on your fiancee.

On the other hand if it was because her name showed up on some type of list regarding terrorism, well who knows.

I'm positive it's not any terrorism thing....it's her hot head that got her into trouble. I imagine they were asking a lot of questions at immigration during that time and she showed them an attitude which they returned.

I'm just hoping that because of that incident, a red flag doesn't go off on our application.

Maybe I'm being naive, but I don't see how this situation could possibly have an effect on the K1 petition you filed for your fiance. I just don't see a connection between an application filed by a US Citizen and a situation involving a foreign fiance's mother in regard to a tourist visa.

Good question. Depending on how closely your fiancee resembles her mother it's possible that there could be an effect.

The mother's name could possibly now be on a list or two, such as IBIS. If the daughter resembles the mother in some way that could create a 'hit', time could be lost while the hit is investigated to determine that your fiancee is not her mother, or that the reason that the mother is on the list is not material to the petition (I've no idea how 'hits' are investigated and cleared, just throwing out two possibilities. I only know that it can take time to clear them).

You are not 'clear' until she has the Visa in hand and even then there have been problems at the POE, see old topics from user: liam4lisa. His situation is not the same as yours, I'm just pointing out that a Visa is not a 100% guarantee to easy USA entrance. A NOA2 only means that the petition has been approved, not the Visa.

Given that the OP's question was whether or not the actions of the fiance's mother might have an effect on the application, I think the answer is no or highly unlikely.

However, clearly, there are a zillion other possiibilities for where the process could go haywire - from namechecks to the interview at the consulate all the way through to the POE in the US. But in regard to the actual application, I highly doubt there will be any effect on the I-129F approval due to the fiance's mother's tourist visa situation.
