What is right way to bring over Canadian fiance?

Hello community and happy new year,

I am a US citizen and have been dating my Canadian girlfriend for 1.5 years now. We have decided to marry, and she will move to the US to live with me.

We plan on applying for the K-1 visa and have all our paperwork for the I-129F and supporting documents ready. However, over the past weeks, we’ve been getting mixed signals from other couples who have successfully married and brought their fiancés over.

Some Canadian immigrants have indicated that the K-1/I-129F process is more for citizens of countries that have a much harder time getting travel visas to the US. And since, my finace has been visiting me on a very regular basis over this past year, that we could just get married with a civil service here and apply for immigration afterwards.

Could you please let me know the pros and cons for a US-Canadian couple using either route?

K1 is for a fiancee and K3 is a virtually obsolete spouse visa. CR1 is generally the preferred spouse visa now. Entering the US using the Canadian visitor privilege with the intent to marry and adjust status (immigrate) is visa fraud and carries the potential of up to a lifetime ban for the Canadian.

The pros and cons for the visa choices for Canadians are the same for those with beneficiaries from other countries.

Because Canadians are offered very generous visitations to the US, do not let this cloud your preceptions of the immigrant visa process. Where is your fiance from? She will either interview in Montreal or Vancouver.

The K-3 is pretty much obselete for most cases, however it can be beneficial for those from Canada depending on your situation (where you'll interview, if your fiance wants to continue to work in Canada for a time after the visa). But more information on your situation will be necessary.

The K-1 fiance visa is for anyone engaged. Cr-1 is for married couples and is a superior visa to the K-3 generally as it allows for work and travel immediatly upon entrance and is a faster, cheaper route to a green card.

Seems like the K-1 is the most straight forward (and legal) way given our situation.

If the "bringing over" is done while a "fiance(e)" then yes. However, it will be months before they can work. If working is a priority then marriage first and CR1 visa later is the most straight forward way.
