Timeline

I'm a USC and my wife has her GC interview scheduled on Feb 8th.

My wife is planning on a 12-14 month trip abroad after she gets her green card in hand since its been like 5 years since she moved to the States.

1. Can she apply for a reentry permit right away after the interview assuming they grant her LPR status?

2. She did her Biometrics 3 months ago. Does she have to get it done again for re-entry permit ?

3. How long does it take to get the re-entry permit ? Can you collect the re-entry permit abroad ?

Filing without a lawyer for my spouse (on H1-B with I-130 approved)

10/22/2009- Package sent to Chicago (I-130 approval, I-485, I-864, I-765, I-131, I-693 and G-325A) by Express UPS ground.

11/02/2009 $1010 Check cashed

11/09/2009 Received Biometrics appointment letter scheduled on 11/25/09

11/12/2009 Completed walk-in Biometrics

11/12/2009 I-131 and I-765 touched

12/22/2009 Received EAD and AP

12/29/2009 Received interview letter

02/08/2010 Interview scheduled

Timeline

the instructions for the I-131 are reasonably good...

1) you must apply before departure...

2) biometrics might be needed

3) you can receive the re-entry permit after departure

Wow . . . a 12 to 14 month vacation!

You guys must be extremely wealthy, and you also must be an extremely understanding husband, if you don't mind that your newly wedded wife moves out of the country for over the year before even the ink on the AOS decision is dry.

We have been married for 5 years and have a child.

Kid needs to be with her grand-parents as well.

Wealthy ? Not at all. Infact its cheaper to live abroad than here :)

3) A few weeks, but all that matters is that the issue date is before her departure date. You can forward it to her overseas.

I believe issue date before departure date for Advance Parole but not for a Re-entry permit. For a re-entry permit the alien needs to in the USA when application is made and for biometrics. Please see instructions to the I-131 regarding Re-entry permits.
